Description | The Town of Portland (the "Town") seeks Proposals from qualified solar developers (the "Bidders") to develop a solar photovoltaic clean energy system (the "System") on Town-owned property on Sand Hill Road containing the Portland Landfill (the "Property"). The Town is seeking Bid Alternates that would participate in either the Non-residential program (the "NRES Program"), with Virtual Net Metering ("VNM") for State, Agricultural, and Municipal ("SAM") properties, administered by Eversource; or the the Shared Clean Energy Facilities Program (the "SCEF Program"), administered by Eversource and the Connecticut Department of Energy and Environmental Protection ("CT DEEP"). Klee Sustainability Advisors LLC ("KSA") and CSW LLC d/b/a CSW Energy ("CSW") are administering this Request for Proposals ("RFP") on behalf of the Town, and are collectively referred to as the "RFP Administrators." It is the Bidder's responsibility to be aware of any updates or addendums to the RFP, which will be posted on both websites. If the Bidder has received a copy of the RFP indirectly, please inform the RFP Administrators at portlandlandfill@solar-rfp.com to be placed on the RFP distribution list. The Town reserves the right to amend or terminate this RFP, accept or reject any proposals, waive any informalities or non-material deficiencies in a proposal, and select the proposal from a Bidder that, in the Town's sole discretion and judgment, will be in the Town's best interests. The Town's decision shall be final, shall not be subject to review or appeal, and may be based on any criteria in the Town's sole discretion, including but not limited to the financial benefit to the Town, the strength of the Bidder's future bid into the competitive NRES Program or SCEF Program, and the experience of the Bidder. Any contracts shall be preceded by a preliminary Notice of Selection and thereafter be contingent and non-binding until all approvals are received from applicable regulatory agencies and town authorities, and successful execution of the relevant contracts.
