Description

The Work contemplated under this Contract includes all labor, materials, transportation, equipment and services for, and incidental to, the completion of all construction work in connection with any Project described in the Contract Documents. The Contractor shall perform all Work necessary so that the Project can be legally occupied and fully used for the intended use as set forth in the Contract Documents. The University of Oregon (UO) is an AA/EEO employer and encourages the submittal of responses from Oregon based businesses including women, minority-owned and emerging small business enterprises. Responsibility of Each Vendor Participating in the Bidding Process: It will be the responsibility of each participating Vendor to refer daily to the UO Business Opportunities website to check for any available opportunities, addendum to current opportunities, cancellations, or intents to award posted there. It is not UO's responsibility to notify participating Vendors by email or by any other means of any of the above. UO has adopted policies applicable to all Vendors/Contractors that prohibit sexual harassment and that the Vendor's/Contractor's company and employees are required to adhere to institutional policies prohibiting sexual harassment in their interactions with members of the institutional community. The Project includes the removal and replacement of the flooring, base cove and stair edge in the upper level charter box and suites with LVP and carpet tile. Bids will be opened on Tuesday, April 4, 2023 at 2:00 PM by the Owner's Representative or designee. Bid results will be posted to the UO Procurement site where the Bid Notification was originally posted. Bids will be received on a lump-sum basis for all of the work. Bid packets may be obtained for no charge on the UO Business Opportunities website. Owner reserves the right to perform other or additional work at or near the Project site with other forces than those of the Contractor. If such work takes place within or next to the Project site, Contractor shall coordinate work with the other contractors or forces, cooperate with all other contractors or forces, carry out the Work in a way that will minimize interference and delay for all forces involved, place and dispose of materials being used so as not to interfere with the operations of another, and join the Work with the work of the others in an acceptable manner and perform it in proper sequence to that of the others. The Owner will resolve any disagreements that may arise between or among Contractor and the other contractors over the method or order of doing all work (including the Work). In case of unavoidable interference, the Owner will establish work priority (including the Work) which generally will be in the sequence that the contracts were awarded. The terms of this Contract shall not be waived, altered, modified, supplemented or amended in any manner whatsoever, without prior written agreement and then only after any necessary approvals have been obtained. An Amendment is required to modify this Contract, which shall not be effective until its execution by the parties to this Contract and all approvals required by public contracting laws have been obtained. Notwithstanding the provisions of the this Section, the terms of this Contract, including any Supplement thereto, may be modified by Owner's issuance of a Construction Change Directive in accordance with the definition of a Construction Change Directive without the prior written agreement of the Contractor.
