Description | The work generally will consist of the demolition of existing asphalt pavement and installation of new concrete pavement, regrading / excavation / installation of a new retaining wall for a new parking lot area and new asphalt pavement at the new parking lot and existing bus depot area. Compliance as required by West Virginia law must be met in the following areas: Compliance with a Nondiscrimination/Sexual Harassment Clause will be made part of the contract, Contractors Responsibility Provisions statement, American with Disabilities Act, Contractor Integrity Provisions, and naming the Mountain Line Transit Authority as additional insured on commercial liability policies. Compliance with Federal law including The Davis-Bacon Act including submission of certified payrolls, Title VI and other applicable provisions of the Civil Rights Act of 1964; the Department of Labor Equal Opportunity Clause (41 CFR 60 -1.4); Section 109 of the Housing and Urban Development Act of 1974; Executive Order 11625 (Utilization of Minority Business Enterprise); Executive Order 12138 (Utilization of Female Business Enterprise); in compliance with Section 504 of Rehabilitation Act of 1973 and Americans with Disabilities Act of 1990. Further, notice is hereby given that this is a Section 3 Project under the Housing and Urban Development Act of 1968, (as amended) and must, to the greatest extent feasible, utilize lower income residents for employment and training opportunities and Section 3 Business concerns and all contracts and subcontracts for this project shall contain the "Section 3 Clause" as set forth in 24 CFR, Part 135.38. Compliance with local ordinances, where applicable, including local building permits & demolition permits. DBE participation is encouraged but not required. The MLTA reserves the right to reject any and all bids, or waive any informality, in the bidding. A noncollusion affidavit must be executed and attached to each bid. Bid proposals that do not have an executed non-collusion statement will be rejected. Any contract resulting from bids submitted is subject to a financial assistance contract between the Authority and the U.S. Department of Transportation. All bidders will be required to certify that they are not on the Comptroller General's List of Ineligible bidders. The successful bidder is required to comply with all applicable Equal Employment Opportunity laws and regulations. The Authority hereby notifies bidders that it will affirmatively insure that in regard to any contract entered into pursuant to this advertisement, minority business enterprises shall be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, sex, creed, age, disability, blindness, religion, familial status, veteran status, or national origin in consideration of an award.
