Description | The Owner reserves the right to accept or reject any or all bid items and alternates and to waive any informalities or defects in the bid proposals either before or after opening Contractor shall pay all license fees and royalties and assume all costs incident to the use in the performance of the Work or the incorporation in the Work of any invention, design, process, product, or device which is the subject of patent rights or copyrights held by others. If a particular invention, design, process, product, or device is specified in the Contract Documents for use in the performance of the Work and if, to the actual knowledge of Owner or Engineer, its use is subject to patent rights or copyrights calling for the payment of any license fee or royalty to others, the existence of such rights shall be disclosed by Owner in the Contract Documents The recipient, upon written request of the Award Official or an authorized representative of the Department of Labor, shall withhold or cause to withhold from the contractor under this contract or any other federal contract with the same prime contractor, or any other federally-assisted contract subject to Davis-Bacon prevailing wage requirements, which is held by the same prime contractor, so much of the accrued payments or advances as may be considered necessary to pay laborers and mechanics, including apprentices, trainees, and helpers, employed by the contractor or any subcontractor the full amount of wages required by the contract. In the event of failure to pay any laborer or mechanic, including any apprentice, trainee, or helper, employed or working on the site of the work, all or part of the wages required by the contract, EPA may, after written notice to the contractor, or recipient take such action as may be necessary to cause the suspension of any further payment, advance, or guarantee of funds until such violations have ceased. Provide and install a gas detection system complete with remote sensing devices, transmitter, displays, calibration equipment, alarm/horn stations, conduit & wire, control panel, and manufacturers cable as follows and as shown/specified on the Contract Drawings: 1. WWTP Influent Room (3 sensor system with remote alarm light/horn stacks). B. Refer to Contract Drawing Riser Diagrams and Floor Plans for device quantities, equipment tags, and additional information. C. Sensors shall monitor for combustible gas (LEL), hydrogen sulfide (H2S), and oxygen depletion (O2). 1. Range of devices to be as follows: a. LEL: 0-100% LEL b. H2S: 0-50 PPM c. O2: 0-25% D. Provide as-built drawings upon completion of installation. E. Provide two year full replacement warranty on all equipment as part of this specification section. Warranty shall replace, with new (not refurbished) equipment. Warranty duration shall commence on the date of substantial completion. Submit warranty informationg during submittal phase. F. Provide commissioning servics, startup services, and training services. A Bid must be accompanied by Bid security made payable to Owner in an amount of 5 percent of Bidders maximum Bid price (determined by adding the base bid and all alternates) and in the form of cash, a certified check, bank money order, or a Bid bond (on the form included in the Bidding Documents) issued by a surety authorized to do business in New York State meeting the requirements of Paragraphs 6.01 and 6.02 of the General Conditions. Simultaneously with his delivery of the executed contract, the successful bidder must deliver to the Owner five (5) originals of an executed bond in the amount of 100% of the accepted bid as security for the faithful performance of the contract and for the payment of all persons performing labor or furnishing materials in connection therewith, prepared in the standard form of Performance Bond (EJCDC Form C-610, 2013 edition), Payment Bond (EJCDC Form C615, 2013 edition) and having as surety thereon such surety company or companies as are acceptable to and approved by the Owner, and as are authorized to transact business in New York State. The bonds must be from a surety company found on the Treasury Circular C-570. Each Bidder must obtain and submit with his Bid the Statement of Surety's Intent attached to the Bid form, completed and signed by a duly authorized surety company licensed to do business in New York State. This requirement will not apply in the case of contracts for supplies only and involving no labor on the site. See Special Conditions for further requirements.
