Description | Notice is hereby given that the Board of Education of the Oceanside Unified School District (District), of the County of San Diego, State of California, will receive sealed bids for Exterior Door and Window Paint Project - Libby ES (Project). Each bid shall be accompanied by cash, a cashiers or certified check, or a bidder bond executed by a surety licensed to do business in the State of California as a surety, made payable to the District, in an amount not less than ten percent (10%) of the maximum amount of the bid. The check or bid bond shall be given as a guarantee that the bidder to whom the contract is awarded will execute the Contract Documents and will provide the required payment and performance bonds and insurance certificates within ten (10) days after the notification of the award of the contract. Each bidder must possess at the time the bid is awarded the following classifications of California State Contractor's license: C-33 - Painting or B General Engineering Contractor. The Board of Education has not found that the Project is substantially complex and therefore requires a standard retention amount of only five percent (5%). A payment bond is required for a public works contract involving an expenditure in excess of twenty-five thousand dollars ($25,000). Separate payment and performance bonds, each in an amount equal to 100% of the total Contract amount, are required, and shall be provided to the District prior to execution of the Contract and shall be in the form set forth in the Contract Documents. All bonds (Bid, Performance, and Payment) must be issued by a California admitted surety as defined in California Code of Civil Procedure section 995.120. OUSD CUPCCAA List of Prequalified Contractors: June 05, 2023 Requests for Clarifications to the Bid Documents Due June 12, 2023 Responses to Requests for Clarifications Sent June 14, 2023 District Sends Out Notice of Intent to Award June 22, 2023 District Ratifies Project Award at Board Meeting June 27, 2023 Project Execution Summer Break 2023 The starting date of the Contract shall be the day listed by the District in the Notice to Proceed, estimated to be approximately July 1, 2023, and the Contractor shall fully complete all the work before June 30, 2024. Time is of the essence in the performance of this Contract. Liquidated damages for the Contractor's failure to complete the Contract within the time fixed for completion are established in the amount of five hundred dollars ($500.00) per calendar day. A bidder's failure to request clarification or interpretation of an apparent error, inconsistency or ambiguity in the Contract Documents waives that bidder's right to thereafter claim entitlement to additional compensation based upon an ambiguity, inconsistency, or error, which should have been discovered by a reasonably prudent Contractor, subject only to the limitations of Public Contract Code 1104. To the fullest extent permitted by law District expressly disclaims responsibility for assumptions a bidder may draw from the presence or absence of information in the bid documents. Any questions relative to the bid shall be in writing and directed to the Purchasing Department at the address specified for receipt of bid proposals. These requests shall be submitted to the District at least seven (7) working days prior to the date the bid is due. This Project is a public works project subject to prevailing wage requirements and Contractor and its Subcontractors are required to pay all workers employed for the performance of this Contract no less than the applicable prevailing wage rate for each such worker. Contractor acknowledges that the project is subject to compliance monitoring and enforcement by the California Department of Industrial Relations in accordance with Labor Code 1770 et seq. |
