Description

Construction of a new groundwater treatment plant, site improvements, an administrative building and demolition of the existing treatment plant. Improvements will be constructed within the approved budget and according to the approved project schedule. The Work shall require a 100% Performance Bond and a 100% Payment Bond from the CM/GC. As part of the contract requirements, the successful Proposer will be required to comply with applicable federal, state, and local laws. All construction completed as a part of this Project will be subject to Oregon Prevailing Wage and federal Davis-Bacon wage requirements. The CM/GC agrees to be bound by and will comply with the provisions of ORS 279C.800 through ORS 279C.870 and 40 U.S.C. 3141 to 3148. The actual Oregon prevailing wage rates applicable to this Project will be identified at the time of the first Early Work Amendment, or, if no Early Work Amendment occurs, then at the time of the Guaranteed Maximum Price ("GMP") Amendment. Applicable federal Davis-Bacon wage rate determinations for this solicitation are included with the solicitation documents. With regard to federal Davis-Bacon wage rates, however, the Department of Labor has interpreted each GMP package as an additional obligation to the construction contract between Owner and the CM/GC which is substantial enough to require an updated wage determination using the current wage determination at the time an amendment, with the purpose of initiating construction on a package or phase of the Project, is exercised. No Proposal for CM/GC services related to this Project shall be received or considered by the Owner unless the Proposer has a current, valid certificate of registration issued by the Construction Contractors Board. Licensing under ORS 468A.720 regarding asbestos abatement projects is not required. The City will be the sole judge in determining award of contract and reserves the right to reject any or all Proposals not in compliance with all prescribed public contracting procedures and requirements, including the requirement to demonstrate the proposer's responsibility under ORS 279C.375(3)(b).
