Description | Reconstruct 0.3 miles of Constitution Drive between MLK Jr. Drive and Bus 190 E. Construction will consist of removal of the existing asphalt and concrete curb and gutter and reconstructing in place with CRCP, Concrete Curb and Gutter and Sidewalk. All employees directly employed on the work shall be paid not less than the established prevailing wage scale for work of a similar character in this locality. A prevailing wage determination for the work has been included with the contract associated with this project and is incorporated therein for all purposes. The Contractor shall pay not less than the general prevailing wages as established by the U.S. Department of Labor and shall keep accurate wage records accessible in accordance with Chapter 2258, Texas Government Code. The City reserves the right to award the bid to either the lowest responsible bidder or to the bidder who provides goods or services at the best value for the City, in accordance with the Texas Local Government Code. Each bid must be accompanied by bid security made payable to the OWNER, in an amount of five percent (5%) of the BIDDER's maximum bid price and in the form of a Bid Bond issued by an acceptable surety, cashier's check, or certified check. It is further agreed by the Parties to this Contract that the contractor will execute separate performance and payment bonds, each in the sum of 100% of the total Contract price in standard forms for this purpose, guaranteeing faithful performance of the work and the fulfillment of any guarantees required and further guaranteeing payment to all persons supplying labor and materials of furnishing him any equipment in the execution of the Contract. These bonds shall also be subject to any provisions in the Supplemental General Conditions to this Contract. It is agreed that the Contract shall not be in effect until such performance and payment bonds are furnished and approved by the OWNER. The cost of the premium for the performance and payment bonds shall be included in the price bid by the Contractor for the work under this Contract, and no extra payment for such bonds will be made by the OWNER.
