Description

The work to be done consists of furnishing all materials, equipment, tools, labor, and incidentals as required by the Plans, Specifications and Contract Documents for the above-stated project. The general items of work to be done hereunder consist of installing sanitary sewer pipe, sewer manhole, 18" DIP water line, water valve & assembly, constructing meandering sidewalk, and installing fiber optic conduit, as well as all other appurtenant or related work as shown or referenced on the plans. Any contract entered into pursuant to this notice will incorporate certain provisions of the State Labor Code. Compliance with the prevailing rates of wages and apprenticeship employment standards established by the State Department of Industrial Relations will be required. No bidders will be discriminated against on the basis of race, denial of family and medical care leave, religious creed (including religious dress and grooming practices), color, national origin (including language use restrictions), ancestry, physical disability or mental disability (including HIV and Aids), medical condition (cancer and genetic characteristics), genetic information, military or veteran status, marital status, gender, gender identity, gender expression, sex (which includes pregnancy, childbirth, breastfeeding and medical conditions related to pregnancy, childbirth or breastfeeding), age or sexual orientation in any consideration leading to the award of contract. Proposals must be accompanied by a proposal guarantee consisting of a certified check or bid bond payable to the CITY in the amount of ten percent (10%) of the total amount bid. If specified in Schedule A, in lieu of payment and performance bonds, CONTRACTOR may furnish CITY either cash, a Letter of Credit, or an Agreement of Deposit as security for performance. Said security shall be in an amount not less than 100% of the cost estimate and, in addition, for payment of those furnishing materials, labor or equipment in an amount not less than 100% of the cost estimate. Said security agreements The contract documents call for monthly progress payments based upon the engineers' estimate of the percentage of work completed. The CITY will retain 5 percent of each progress payment as security for completion of the balance of the work. At the request and expense of the successful bidder, the City will pay the amounts retained upon compliance with the requirements of Public Contract Code, Part 5, Section 22300, and the provisions of the contract documents pertaining to Substitution of Securities City staff will not be available to respond to questions on the day of bid opening. The CITY reserves the right to reject any or all bids, to waive any irregularity, to accept any bid or portion thereof, and to take all bids under advisement for a period of sixty (60) days. At the time of contract award, the prime contractor shall possess a valid Class A contractor's license and/or a combination of Class "C" specialty contractor's license(s) sufficient to perform the work.
