Description | Provide a bid cover sheet that must be signed by an authorized representative of the company named thereon. The signature on this form shall be interpreted to signify the vendors intent to comply with all terms, conditions, and specifications set forth in this solicitation, unless specific exceptions are noted on the face of the bid. Bidders must state a delivery date and all bidders are hereby advised that delivery will be an important factor in award of this bid. Stated delivery date must be based upon factory projections and the City may require written confirmation of projected delivery date from the factory prior to award of the purchase order. Bidders are advised that failure to meet projected delivery dates without acceptable cause may result in removal of the vendor from the bid list. All deliveries will be made to the Washington City Public Works located at 1305 East Washington Dam Rd Washington Utah 84780. Washington City may deduct as liquidated damages from any money due to the vendor, an amount equal to .0025 of the accepted dealer total bid delivery price, per unit, per day, for each and every calendar day during which the contract remains unfinished or incomplete. Any monies deducted are not to be construed as a penalty, but as liquidated damages to compensate for additional costs and inconvenience incurred by the city. The rights and remedies provided for in these specifications shall be in addition to and not a limitation of any rights and remedies otherwise available at law. In any lawsuit involving the assessment or recovery of liquidated damages, the reasonableness of the charge therefore shall be presumed and the amount assessed shall be in addition to every other remedy now or hereinafter enforceable at law, in equity, by statute under the contract. Washington City will be allowed a minimum of seven (7) days following delivery of the equipment specified to inspect said equipment and either accept or reject the same. Washington City reserves the right to reject any equipment delivered, or any part of said equipment, if said equipment or part thereof fails to conform in every respect to the equipment specifications set forth in this solicitation. Washington City reserves the option to cancel any accepted bid, in its entirety, due to non-conformance on the part of the vendor, and to accept the next lowest responsive bid. Any bidder who willfully falsifies responses indicating compliance or non-compliance with the minimum requirements listed will be subject to suspension and/or debarment from bidding. All bids must be filled out completely for the bid to be valid. Washington City will have the option to purchase additional equipment/vehicles with similar specifications for a term of up to 90 days after awarding of this bid.
