Description | This construction package consists of drilling and developing Wilcox Water Well No. 1, including pressure cementing, video survey, 36-hour pump test, water quality sampling, downhole equipment, vertical turbine pump and well head completion for Crystal Clear Special Utilities District. The project also consists of clearing and grubbing the water well area and fence lines along the edge of the property and installing barbed wire fence and gates. All questions about the meaning or intent of the Bidding Documents shall be submitted in writing and must be received at least seven calendar days prior to the opening date. Proposals will be received for a single Contract. Proposals shall be provided on a unit price basis as indicated in the Bid Form. Crystal Clear Special Utility District expressly reserves the right to reject any or all Proposals and to waive minor irregularities or informalities. The project will be awarded to the highest scoring respondent based on set evaluation criteria. A Respondent's failure to respond to the requested qualifications inquiry may result in the proposal being deemed non-responsive. Proposals may be held by Crystal Clear Special Utility District for a period not to exceed 60 days from the date of bid opening for the purpose of reviewing the proposals and evaluating respondent's qualifications prior to the contract award. This contract is contingent upon release of funds from the Texas Water Development Board (TWDB). Any contract or contracts awarded under this Request for Proposals (RFP) are expected to be funded in part by financial assistance from the TWDB. Neither the U.S. Environmental Protection Agency (EPA) or the State of Texas, nor any of its departments, agencies, or employees, are or will be a party to this RFP or any resulting contract. Any contract(s) awarded under this RFP is/are subject to the American Iron and Steel (AIS) requirements of federal law, including federal appropriation acts and Section 1452(a)(4) of the Safe Drinking Water Act (42 U.S.C. 300j-12(a)(4)), as applicable. This contract is subject to the Environmental Protection Agency's (EPA) Disadvantaged Business Enterprise (DBE) Program, which includes EPA-approved fair share goals toward procurement of Minority and Women-owned business Enterprise (M/WBE) business. EPA rules require that applicants and prime contractors make a good faith effort toward a fair share of contracts, subcontracts, and procurements to M/WBEs through demonstration of the six affirmative steps. Any contract awarded under the RFP will be required to comply with the Department of Labor regulations at 41 CFR Part 60-4, relating to Construction Contractors--Affirmative Action Requirements, which include the President's Executive Order No. 11246, as amended by Executive Order No. 11375 and Executive Order No. 13672, in the award and administration of contracts awarded under TWDB financial assistance agreements. Failure by the Contractor to carry out these requirements is a material breach, which may result in the termination of the awarded financial assistance. Davis-Bacon prevailing wage requirements apply. A bid bond in the amount of five percent (5%) of the bid issued by an acceptable surety shall be submitted with each proposal. The successful respondent will be required to furnish a Performance Bond and a Payment Bond, each in the amount of the contract, written by a responsible Surety Company, authorized to do business in the State of Texas.
