Description

Frontier Elementary School Fencing Project. Project scope includes but is not limited to placement of new fencing and gates to secure the campus as well as accessibility upgrades as shown in project documents for a complete and operational project. Work to be performed during normal business hours. The Contractor shall furnish all labor, materials, equipment, tools, and utility and transportation services, and perform and complete all work required in connection with in strict accordance with the Contract Documents enumerated in Article 7 below. The Contractor shall be liable to the District for any damages arising as a result of a failure to comply with that obligation, and the Contractor shall not be excused with respect to any failure to so comply by an act or omission of the Architect, Engineer, Inspector, Division of the State Architect (DSA), or representative of any of them, unless such act or omission actually prevents the Contractor from fully complying with the Contract Documents and the Contractor protests, in accordance with the Contract Documents, that the act or omission is preventing the Contractor from fully complying with the Contract Documents. Such protest shall not be effective unless reduced to writing and filed with the District office within seven (7) days of the date of occurrence of such act or omission preventing the Contractor from fully complying with the Contract Documents. Bids not submitted on the proper forms will be rejected as non-responsive. This is a PREVAILING WAGE project. Bid RFI's Due to District November 18, 2022 @ 2:15 pm Prime Contractor bidders shall be required to have a valid Class "A" or "B" Contractor's License. Bids must be from an appropriately licensed contractor and must be sealed. Interested bidders must be appropriately licensed. Each Bid must be accompanied by one of the following forms of bidder's security: (1) cash; (2) a cashier's check made payable to the District; (3) a certified check made payable to the District; or (4) a bidder's bond executed by a California admitted surety as defined in Code of Civil Procedure section 995.120, made payable to the District in the form set forth in the Bid Documents. Such bidder's security must be in an amount not less than ten percent (10%) of the maximum amount of bid, as a guarantee that the bidder will enter into the proposed Contract, if the same is awarded to such bidder, and will provide the required performance and payment Bonds, insurance certificates and any other required documents. In the event of failure to enter into said Contract or provide the necessary documents, said security will be forfeited. The Bid opening and hand delivery of Bids on the day of the Bid opening shall take place at the Purchasing Office of the Twin Rivers Unified School District, 3222 Winona Way, Suite 200, North Highlands, California 95660. It is each bidder's sole responsibility to ensure its bid is timely delivered and received at the location designated. Any bid received at the designated location after the scheduled closing time for receipt of bids shall be returned to the bidder unopened. At the bidder's sole discretion, Bids may be mailed to that they are received by the District prior to the hour and date of the Bid opening and shall be addressed to the Purchasing Office, attention: Debbie Gordon, of the Twin Rivers Unified School District, 3222 Winona Way, Suite 200, North Highlands, California 95660. It is each bidder's sole responsibility to ensure its bid is timely delivered and received at the location designated. The District is not responsible for misdirected mail or other failure of any bid to be delivered to the required location. Any bid received at the designated location after the scheduled closing time for receipt of bids shall be returned to the bidder unopened Bidders are hereby notified that pursuant to section 1770 et seq. of the Labor Code of the State of California, the Director of Industrial Relations has ascertained the general prevailing rate of per diem wages and the rates for overtime and holiday work in the locality in which the work is to be performed for each craft, classification or type of workman needed to execute the Contract which will be awarded to the successful bidder. Copies are on file with and available upon request from the District. At the request and expense of the successful bidder, securities equivalent to the amount withheld from progress payments (i.e., retention) may be deposited with the District, or with a state or Federally chartered bank as the escrow agent (the successful bidder shall bear all costs of escrow) and the District shall pay monies which would otherwise be retained to the successful bidder. The form of escrow agreement and securities eligible for investment pursuant to this option shall be governed by Public Contract Code Section 22300 and Government Code Section 16430. Within 10 days after notification of the Award of Contract, the successful bidder or bidders will be required to furnish, simultaneously with execution of the Contract, a Labor and Material Payment Bond and a Faithful Performance Bond in the form required by the District, each in an amount equal to one hundred percent (100%) of the Contract Price from an admitted surety company as defined in Code of Civil Procedure section 995.120. In accordance with Education Code Section 17076.11, District has established a participation goal for Disabled Veteran Business Enterprises (DVBE). Bidder shall be familiar with this provision and provide the necessary information as indicated in the Instructions to Bidders. In determining the lowest responsive Bid, District intends to consider only the base bid. The Contract Documents for the Project have many unique requirements. Bidders are cautioned to carefully review all of the Contract Documents prior to submitting a Bid and to obtain pre-Bid clarification of any provision which bidder believes is ambiguous or confusing, as provided for in the Contract Documents. The Board reserves the right to reject any or all Bids, and further reserves the right to waive any informalities or irregularities in the Bids or in the bidding. Pursuant to Labor Code sections 1725.5 and 1771.1, all contractors and subcontractors that wish to bid on, be listed in a bid or enter into a contract to perform public work must be registered with the Department of Industrial Relations. No bid will be accepted nor any contract entered into without proof of the contractor's and subcontractors' current registration with the Department of Industrial Relations to perform work. If awarded a Contract, the Bidder and its subcontractors, of any tier, shall maintain active registration with the Department of Industrial Relations for the duration of the Project This Project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. In bidding on this project, it shall be the Bidder's sole responsibility to evaluate and include the cost of complying with all labor compliance requirements under this Contract and applicable law in its bid.
