Description | The Work, includes, but is not necessarily limited to: a. Approximately 20,225 LF of various gravity sewer pipe (ranging from 8" to 48" in diameter) are candidates for trenchless (Cured-In-Place) rehabilitation. b. Approximately 26 Manholes are candidates for rehabilitation. c. Approximately 13 Laterals are candidates for rehabilitation The Contractor shall note that work shall not be performed on the barrier island between May 15 and September 15. The sanitary sewer lines, etc are shown on the Drawings. Bid Security - In accordance with N.J.S.A. 40A:11-21, each Bid shall enclose Bid Security, as specified in the Instructions to Bidders, in the amount of ten percent (10%) of the Bidder's Base Bid plus all alternates, but not in excess of $20,000. Bidders are required to comply with the requirements of P.L. 1975, c. 127 (N.J.S.A. 10:5-33 et seq. and N.J.A.C. 17:27), equal employment opportunities P.L. 1977, c.33, corporate and/or partnership ownership and P.L. 2004, c. 57, business registration of public contracts and the "Public Works Contractor Registration Act" (N.J.S.A. 34:11). Labor Standards Provisions for Federal and Federally-Assisted Contracts - The "construction" work (as defined by the Secretary of Labor) shall be subject to the following labor standards provisions, to the extent applicable: a. Davis-Bacon Act (40 U.S.C. 276a--276a-7). b. Contract Work Hours and Safety Standards Act (40 U.S.C. 327-33). c. Copeland Anti-Kickback Act (18 U.S.C. 874). d. Executive Order 11256 (equal employment opportunity). and implementing rules, regulations, and relevant orders of the Secretary of Labor or EPA. This contract shall include and be subject to the "Labor Standards Provisions for Federally-Assisted Construction Contracts" (EPA Form 5720-4) in effect at the time of execution of this contract. Local Public Contract Requirements - The New Jersey Department of Labor and Industry's applicable prevailing wage rates are those wages and fringe benefits in effect on the date the contract is awarded. All pre-determined rate increases listed at the time the contract is awarded must also be paid, beginning on the dates specified. The Supplementary Conditions, Section 00800, also contain provisions concerning "Nondiscrimination Requirements." New Jersey Election Law Enforcement Commission - Bidders will be required to comply with the requirements of the New Jersey Election Law Enforcement Commission pursuant to N.J.S.A. 19:44A-20.4 and N.J.S.A. 19:44A-20.13 (P.L. 2005, c271, s.3). All questions or inquiries concerning the Bidding Documents or the Work shall be submitted in "writing", with "SR-01-20" indicated as the subject/reference, via fax (732-244-4691), or email (cjacquemot@tomsrivermua.org), or at the postal mailing address given herein for the Toms River Municipal Utilities Authority. Questions or inquiries will be addressed by Toms River Municipal Utilities Authority Field Engineering Asst. Award - Subject to any agreed extension of the period for holding Bids, the Owner will act within sixty (60) days after the date of Bid opening to award the Contract, reject any or all Bids or take any other appropriate action. The Owner expressly reserves the right to reject any or all Bids, waive any non-conformances, readvertise for Bids or withhold the award for any reason the Owner determines. This contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey I-Bank, and the successful bidder must comply with all the provisions of NJAC 7:22-9.1 et seq., for the participation of small business enterprises owned and controlled by socially and economically disadvantage individuals (SEDs). Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10. In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a)24 and 4.17(a)24, the contractor (subcontractor) shall comply with all of the provisions of N.J.A.C. 7:22-9. These specifications shall encourage free, open and competitive bidding, and shall adhere to aspects of specifying "brand name or equivalent", etc., as per NJSA 40A:11-13(d). |
