Description

Desert Learning Academy Building 500 Rebuild - Increment 2 Submission of a bid proposal shall constitute acceptance of the terms and conditions of contained in the Notice Inviting Bids and the General Conditions and Bid Instructions a firm offer to the District for ninety (90) calendar days from the submission deadline for proposals. Requests for modification or clarification of any requirement must be submitted in writing electronically by Monday, August 29, 2022 2:00 pm . Contract award is contingent upon availability of funds. This RFP is subject to the provisions of Education Code Section 45125.1. et. seq. Please note that as a pre-condition of entering into a contract with the District, Contractor is required to comply with the criminal background check provisions of Education Code Section 45125.1.District will conduct criminal background checks with the California Department of Justice (CDOJ) and the FBI for all Contractor's employees, agents, and volunteers assigned to the District, and Contractor will certify that no employees, agents, or volunteers who have been convicted of serious or violent felonies as specified, will have contact with students being served pursuant to the terms of this Agreement, if any. However, such certification shall not relive the Contractor, its agents, employees, volunteers, and interns of the obligation to complete the background check and fingerprinting process set forth herein. The certification regarding felony conviction does not apply to an employee, agent or volunteer who has obtained a certificate of rehabilitation and pardon pursuant to California Penal Code Section 4852.01 et seq. for a serious or violent felony listed under EC 45122.1. Contractors providing construction, reconstruction, rehabilitation, or repair services where the employees of the entity will have contact, other than limited contact, with pupils shall ensure the safety of the pupils by the installation of a physical barrier at the worksite to limit contact with pupils. The District reserves the right to accept or reject any or all bids, and to accept or reject any item, to withdraw a line item or entire RFP, or to waive any irregularities or informalities in the bids or in the bidding. The District may award any, all or none of this RFP. Any resultant award by the Board of Education will be by Section to the lowest responsible bidders in accordance with applicable law.
