Description

Bid Proposals by the Passaic Valley Sewerage Commission (PVSC) for: CONTRACT NO. B285 Thickening Centrifuge Improvements Project. (If forwarded by mail, the sealed envelope containing the proposal, marked as directed above must be enclosed in another envelope addressed as specified in the Proposal, preferably by registered mail.) (If forwarded by express carrier or other delivery service, please be advised that access to the PVSC is restricted to the following address: 734 Wilson Avenue, Newark, New Jersey 07105). The outside envelope containing bids must clearly identify the Contract Number, Contract Name, and Bid Opening Date. Failure to follow this procedure is grounds for rejection. They must be sealed and identified as indicated above, enclosed in a mailing envelope with proper postage, and received prior to and up to the date and time set for receiving sealed bid proposals. Security Notice: All contractors, subcontractor's employees and/or representatives entering the plant must have and must present to PVSC Security, government issued identification such as a valid picture Driver's License or Passport. This requirement applies to pre-bid conferences and all on-premises contract work. Interested parties and members of the public may also submit questions and comments via email to the PVSC Clerk at ClerksOffice@pvsc.com and those questions and comments will be read into the record and addressed. Bid Proposals may be withdrawn or modified prior to the time for the opening of bids or the authorized postponement thereof. Except as permitted by N.J.S.A. 40A:11-23.3, no bid may be withdrawn for a period of 60 calendar days after the date of the opening of bids. PVSC reserves the right to reject all Bids and waive any minor Bid informalities, defects or irregularities, pursuant to Local Public Contract Law, when it has sound documented business reasons. Any award will be made to the lowest responsible bidder. No bid will be received unless in writing on the forms furnished, and unless accompanied by bid security in the form of a bid bond, cashier's check, or a certified check made payable to the PVSC in an amount equal to 10% of the amount of the total bid, but not exceeding $20,000, executed by a Surety Company duly authorized to do business in the State of New Jersey. The successful Bidder must furnish a 100 percent construction performance bond, and a 100 percent construction payment bond, a maintenance bond, and an environmental maintenance bond with a surety company acceptable to the Owner. Complete instructions for preparing Bids and required bonds are included in the Bidding Documents. Work to be performed under Contract No. B285 includes furnishing all labor, materials, supplies, equipment and other facilities required by the Contract Documents for improvements to the thickening centrifuges and related equipment. Work includes, but not limited to, installation of a new centrifuge, sludge feed pump and related equipment, replacement of the polymer feed systems, installation of a dual automatic backwash strainer for the NPW system, upgrade of odor control system fan motors, rehabilitation of the North and South Wet Wells, installation of two sludge screenings washer compactors, and upgrade of related electrical, instrumentation and controls. If for any reason, the Contract is not awarded, refunds of the Bidding Documents fee will be immediately returned to Bidders when the Bidding Documents are returned in reasonable condition within 90 days of notice that the Contract has not been awarded. In the event that a potential bidder obtains the Bid Documents in any manner other than as specified herein, the Passaic Valley Sewerage Commission will not have the contact information of the potential bidder for purposes of issuing bid addenda, if any. In such instances, the non-receipt of any addenda (in the event that any addenda are issued) and the failure of the bidder to acknowledge the receipt of any and all addenda at the time of bid shall be considered a fatal defect in such Bidder's submission and said Bid shall be immediately rejected. Therefore, if a potential bidder obtains the Bid Documents in any manner other than as specified herein, said Bidder shall promptly provide written notice to CDM Smith, Inc. accordingly. All Bidders and their subcontractors of any tier listed in the bid documents pursuant to N.J.S.A. 40A:11-16, shall be registered with the New Jersey Department of Labor and Workforce Development pursuant to the Public Works Contractor Registration Act, N.J.S.A 34:11-56.48 et seq. A copy of the Bidder's registration certificate is recommended to be provided with each bid; but the certificate must be submitted prior to award of the Contract. The Contract is expected to be funded in part with the funds from the NJDEP and the NJEIT and is subject to availability of funds. Neither the United States nor the State of New Jersey, the NJEIT, nor any of their departments, agencies, or employees is, or will be, a party to the Contract or any lower tier contract or subcontract. The Contract or Subcontract will be subject to regulations contained in N.J.A.C. 7:22-3.1 et seq., 4.1 et seq., 5.1 et seq., 9.1 et seq. and 10 et seq., Local Public Contracts Law, Department of Labor and Workforce Development Current Wage Rate Determination, Prevailing Wage Act, Contract Work Hours and Safety Standard Act, Copland Act, Davis Bacon Act, Buy American Clause, Debarment and Suspension, and Socially and Economically Disadvantaged (SED) (N.J.A.C. 7:22-9.1 et seq.). Pursuant to N.J.S.A. 10:5-33: "Bidders are required to comply with the requirements of P.L. 1975, c.127." All bidders are encouraged to include a commitment to the use of small, minority, women's and labor surplus area businesses and shall be in conformity with N.J.A.C. 7:22-3.17(a)(24) and 7:22-4.17(a)(24) with a goal of not less than 10% participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SED's).
