Description

Contract Scope of work includes 1. Cleaning and cement mortar lining of approximately 1,700 linear feet of 8-inch cast iron water main. 2. Installation of 2-inch and 4-inch temporary bypass piping and building service connections. 3. Installation of gate valves and hydrants where specified within the lining limits of the contract. 4. All other pertinent work, including but not limited to testing, disinfection, restoration, and all other work necessary to complete the project as described in the Contract Specifications and Contract Plans. Submission of Bid The Borough of Sussex requires that a bidder must submit with his bid, a bid guarantee in the form of a bid bond, certified check, or cashiers check in the amount of ten percent of the bid, along with consent of surety from a Bonding Company. In no case shall the bid guarantee exceed $20,000.00. The bid guarantee must be accompanied by a surety company certificate (known as a Consent of Surety) duly authorized to do business in this State and satisfactory to the Borough of Sussex, stating that such surety company will provide the bidder with a guarantee bond or other surety as a guarantee indemnification. Failure to include this item will mandate rejection of bid. The Borough of Sussex requires that a bidder who is awarded a contract, which exceeds $44,000.00, must submit a Performance Bond in the full amount of the award from a Company doing business in the State of New Jersey. This bond shall be made payable to the Borough of Sussex and shall be held as security for the performance of the contract. The performance bond shall be submitted within ten (10) days of the date of the award letter. Failure to submit a Performance Bond shall be cause for declaring the contract null and void. Funding for this project is provided by The United States Department of Housing and Urban Development through the Borough of Sussex Department of Community Development. Therefore, all Federal Prevailing Wage Regulations as well as Federal Labor Standards will apply. Attention is called to the fact that the Contractor must ensure that employees and applicants for employment are not discriminated against because of their race, creed, color, sex or national origin and to the greatest extent possible, opportunities for training and employment shall be given to lower-income residents of the project area and that, when possible, contracts shall be awarded to business concerns owned by area residents. Small, Minority, and Womens Business Enterprises are encouraged to submit bids. Bids or proposals in excess of $100,000.00 must be accompanied by a written affirmative action plan. All contracts, subcontracts, and subgrants in amounts in excess of $100,000 shall contain a provision which requires compliance with the requirements of Section 306 of the Clean Air Act (42 USC 1857 h), Section 508 of the Clean Water Act (33 USC 1368), Executive Order 11738, and Environmental Protection Department regulations (40 CFR part 15). All Contracts and subcontracts for construction or purchase of materials are subject to Section 3 of the Housing and Urban Development Act of 1968 as amended, 12 U.S.C. 1801u where to the greatest extent possible, opportunities for training and employment shall be given to lower income residents of the project area, and when possible, contracts shall be awarded to business concerns owned by area residents. Bidders must comply with regulations of the New Jersey Local Public Contract Law (N.J.S.A.40A: 11-1et.seq.), Affirmative Action regulations N.J.S.A.10:5-31et seq., N.J.A.C. 17:27, the New Jersey Prevailing Wage Act 12:60-1 et seq. (N.J.S.A.34:11-56-1 et. seq., N.J.S.A.34:11-56.25 et. seq.) and the New Jersey Contractor Business Registration Certificate N.J.S.A.52.32-44. Prior to awarding of a contract, the Borough of Sussex will investigate apparent low bidders for any delinquent taxes or other Municipal charges including but not limited to sewer charges, demolition liens, etc. owed on any Borough of Sussex property by said proposed vendor or its principals. Any such delinquent taxes or other Municipal charges would disqualify such bidders from bidding on or being awarded a contract. The Municipal Council of the Borough of Sussex reserves the right to consider bids for sixty (60) days after receipt thereof, and further reserves the right to reject any and all bids, waive informalities, and make such awards or take action in accordance with applicable law. The Public Works Contractor Registration Act N.J.S.A.34:11-56.48 et. seq. requires that a general or prime contractor and any listed subcontractors names in the contractors bid proposal shall be registered at the time the bid proposal is submitted. After bid proposals are received and prior to award of contract, the successful contractor shall submit a copy of the contactors certification along with those of all listed subcontractors. All non-listed subcontractors and lower tier subcontractors shall be registered prior to starting work on the project. It is the general contractors responsibility that all non-listed sub-contractors at any tier have their certificate prior to physically starting work on the job. Other requirements as well as those described above are fully detailed in the bid document. Bidders shall familiarize themselves with the requirements of Article No. 28 (Substitutions) of the General Conditions as it pertains to the utilization of approved equal equipment or material. Bidders under this Contract shall follow, State guidelines for the minimum wage rates and conditions of employment. This bid has been advertised in accordance with the Fair and Open Basis and nothing further shall be required under the Pay-to-Play Legislation (N.J.S.A. 19:44A-20.7).
