Description | Livermore Falls Water District & Town of Livermore Falls Church, Knapp and Millett Street Utility Improvements Livermore Falls, Maine General Notice Livermore Falls Water District & Town of Livermore Falls (Owner) is requesting Bids for the construction of the following Project: Church, Knapp and Millett Street Utility Improvements Bids for the construction of the Project. The Project includes the following Work: Replacement of water mains, services, hydrants and appurtenances in Church Street, Knapp Street and Millett Street in Livermore Falls. Also included is the replacement of sewer mains and services, addition of manholes on dead end lines, and replacement of existing sewer manholes. Sewer work is contingent of the Town receiving funding in the 2023 CWSRF funding cycle. To be considered a responsive Bidder, the Bidder shall have obtained at least one set of Bidding Documents from the Issuing Office using the name that is to appear on the Bid Form. The designated website will be updated periodically with addenda, lists of plan holders, reports, and other information relevant to submitting a Bid for the Project. All official notifications, addenda, and other Bidding Documents will be offered only through the designated website. Neither Owner nor Engineer will be responsible for Bidding Documents, including addenda, if any, obtained from sources other than the designated website. It is the Bidder's responsibility to check the designated website for addenda. Pre-bid Conference A pre-bid conference for the Project will not be held. American Iron and Steel Section 746 of Title VII of the Consolidated Appropriations Act of 2017 (Division A - Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2017) and subsequent statutes mandating domestic preference applies an American Iron and Steel requirement to this project. All iron and steel products used in this project must be produced in the United States. The term "iron and steel products" means the following products made primarily of iron or steel: lined or unlined pipes and fittings, manhole covers and other municipal castings, hydrants, tanks, flanges, pipe clamps and restraints, valves, structural steel, reinforced precast concrete, and Construction Materials. The following waivers apply to this Contract: 1) De Minimis, 2) Minor Components, 3) Pig iron and direct reduced iron. Bid Guarantee A certified check or bank draft payable to the Owner or a satisfactory Bid Bond executed by the Bidder and a Surety Company in an amount equal to five percent (5%) of the Bid shall be submitted with each bid. No bid may be withdrawn for at least 60 days after receipt of bids unless released by the owner. Performance and Payment Bonds are required for one hundred percent (100%) of the contract price. Disadvantaged Business Enterprise Requirements Each Bidder shall take special notice of the Guidance for use of Disadvantaged Business Enterprises in the DWSRF Supplemental General Conditions. Failure to complete these requirements may result in finding that the Bidder is nonresponsive and therefore, not eligible to be awarded this contract. Complete requirements are located in the Bid Documents. American Iron and Steel (AIS) Requirements The Contractor shall comply with the Use of American Iron and Steel in in accordance with Public Law 113-76, Section 436. Davis-Bacon Wage Rate Requirements Davis-Bacon Wage Rates apply to this project. Nondiscrimination in Employment and Labor Standards Bidders on this work will be required to comply with the President's Executive Order No. 11246 and amendments and supplements to that Order. The requirements for Bidders and Contractors under this Order are located in the DWSRF Supplemental General Conditions. Federal Requirements The Contractor must comply with the Department of Labor Regulations relating to Copeland "Anti-Kickback Act (18 U.S.C. 874) as supplemented by 29 CFR part 3, Contract Work Hours and Safety Standards Act (40 U.S.C. 327-330) as supplemented by 29 CFR part 5, Occupational Safety and Health Standards (OSHA) (29 CFR part 1910), and Executive Order 14026. The Contractor must comply with all applicable standards, orders, or requirements issued under section 306 of the Clean Air Act (42 U.S.C. 1857(h)), section 508 of the Clean Water Act (33 U.S.C. 1368), Safe Drinking Water Act, Executive Order 11738, and the Environmental Protection Agency regulations (40 CFR Part 15). The Contractor must comply with all permits, restrictions and conditions, issued for the Project by Federal Cross-cutting Authorities. Disclaimer Any contract awarded under this Advertisement to Bidders is expected to be funded in part by the Maine Drinking Water State Revolving Fund and the Maine Department of Environmental Protection Clean Water State Revolving Fund. Neither the State of Maine nor any of its departments, agencies, or employees is, or will be, party to the Contract.
