Description

UConn will use reasonable efforts to not disclose information properly marked confidential. UConn provides no assurance whether any such submitted information shall be legally exempt from release pursuant to FOIA. In the event that a requestor files a complaint with the FOIA Commission challenging such exemptions, UConn will make reasonable efforts to notify respondents and acknowledges and agrees that respondent has the right to petition to intervene and become a party to the complaint and any subsequent judicial appeal proceedings. As long as respondent is, in accordance with FOIA law and regulations, engaged in efforts to prevent the disclosure of the contested information, UConn shall not disclose the contested information without a final order from the FOIA Commission requiring such disclosure. Should respondent not intervene, disclosure of all information submitted in response to an ITB may occur at UConn's sole discretion. Respondent shall be responsible for the costs and expenses it incurs contesting the disclosure of any contested information. The Project will be awarded to the responsible, qualified Bidder submitting the lowest Total Bid Award in compliance with the bid requirements and within the budget, subject to the provisions of Connecticut General Statute 10a-109a through 10a-109y. The University reserves the right to elect to implement some, all or none of the Alternates set forth in this Bid, as may be in the best interest of the University. To ensure that the integrity of the bidding process is maintained, the Total Bid Amount and any Alternates are read at the bid opening. After the bid opening and before the contract award, the lowest responsible Bidder is determined by adding together the Total Bid Amount plus any Alternates (additive or deductive) accepted by the University. Alternate prices are not negotiable since they are a component in determining the lowest responsible Bidder. Each Bid shall be accompanied by a Bid Bond in the form required and provided by University and having as surety thereto such surety company or companies as are authorized to do business in the State of Connecticut, and for an amount not less than 10 percent of the Total Bid Amount. A Bid Bond is only required for any Total Bid Amount over $50,000.00. A Total Bid Amount of $50,000.00 or less does not require a Bid Bond. Performance Bond (for Bids over $100,000.00): If the contract amount is at least $100,000.00, then prior to the execution of the contract, the successful Bidder shall submit an executed Performance Bond, prepared on the form of Performance Bond provided by the University, in the amount of 100 percent of the contract amount, conditioned upon the faithful performance of the contract, and having as surety hereto such Surety Company or Companies as are authorized to transact business in the State of Connecticut. A Pre-Award Protest must be submitted no less than two (2) business days prior to the due date for the bid/proposal. A Post-Award Protest must be submitted no more than two (2) business days from the date the bid/proposal results are posted on the CPFP website. Contact the CPFP Purchasing Agent listed in this solicitation for further information on the bid protest procedure. The University of Connecticut is a tax-exempt institution. The tax on materials or supplies exempted by the current regulations of the Department of Revenue Service shall not be included as part of the Total Bid Amount. A Sales Tax Certificate is available from the Purchasing Department upon written request. The Bidder, in accordance with Connecticut General Statute 4b-95, shall furnish with his submitted Bid, the names, and prices of responsible and qualified Subcontractors who are to perform the following categories of Work, if their prices exceed $100,000.00: Masonry Electrical Plumbing Heating, Ventilating, and Air Conditioning Pursuant to Connecticut General Statute Section 49-41a, Enforcement of payment by the general contractor to subcontractor and by subcontractor to its contractors, for every contract with the University for the construction, alteration or repair of any building or work, (1) the contractor, within 30 days after payment to the contractor by the University, shall be required to pay any amounts due any subcontractor, whether for labor performed or materials furnished, when the labor or materials have been included in a requisition submitted by the contractor and paid by the University; (2) the contractor shall include in each of its subcontracts a provision requiring each subcontractor to pay any amounts due any of its subcontractors, whether for labor performed or materials furnished, within 30 days after each subcontractor receives a payment from the contractor which encompasses labor or materials furnished by such subcontractor. Attention is called to the fact that there may be construction work now being carried on at the site by union labor. This fact must be kept in mind by all Bidders submitting bids for this work. The University reserves the right to request additional information from a Bidder beyond what is submitted 4 The University expressly reserves the right to reject any and all bids and to waive any informalities, irregularities or technical defects in the Bids, if it is deemed to be in the best interest of the University provided the reasons for any such waiver are stated in writing by the University and made a part of the contract file. *The value for this project is based on a financial range of $100,000 - $500,000.
