Description | The work will generally consist of demolition; clearing and grubbing; excavation; borrow; grading; pipework; bridge work; asphalt; concrete work; seeding and mulching; and all appurtenant work as indicated on the drawings and as specified. Please pay close attention to State Prevailing Wage Determination and OSHA Safety Training requirement per R.S.Mo 292.675 The City reserves the right to accept or reject any or all bids. The City of St. Joseph is an Equal Opportunity Employer. Bid will be received on a lump sum basis including alternatives described in the Contract Document. Bid security in the amount of Five Percent (5%) of the total Bid must accompany each Bid. All Bids must be in accordance with the Bidding Documents on file with the Purchasing Division, 1100 Frederick Avenue, Room 201, St. Joseph, Missouri 64501. The Successful Bidder will be required to furnish a Performance and Maintenance Bond and a Payment Bond on the forms set forth in the Contract Documents as security for the faithful performance of, and the payment of all bills and obligations arising from the performance of, the Contract. Bidders will be required to comply with the following requirements: Wage Rates Equal Opportunity in Employment All other applicable Laws and terms and conditions set forth in the General Conditions of the Contract for Construction Nondiscrimination in Employment. Bidders on this Work will be required to comply with the President's Executive Order Number 11246. Requirements for Bidders and contractors under this order are explained in the Specifications. No Bid may be withdrawn within a period of Sixty (60) days after the date fixed for opening Bids. The City reserves the right to reject any or all Bids, including, without limitation, the right to reject any or all nonconforming, nonresponsive, unbalanced, or conditional Bids, and to reject the Bid of any Bidder if the City believes that it would not be in the best interest of the City to make an award to that Bidder. The City also reserves the right to waive informalities. Safety Training Bidders are hereby informed that this project is subject to the requirements of R.S.Mo. 292.675, which requires all contractors or subcontractors doing work on the project to provide, and require its on-site employees to complete, a ten (10) hour course in construction safety and health approved by the Occupational Safety and Health Administration or a similar program approved by the Missouri Department of Labor and Industrial Relations which is at least as stringent as an approved OSHA program. All on-site employees must have the required OSHA training completed within 60 days of the date which work on the project commences. Any on-site employees found on the worksite without documentation of the required training shall have 20 days to produce such documentation. Prohibition Against Gratuities and Kickbacks The Bids and Contract referred to in this Invitation to Bidders are subject to the provisions of the Purchasing Ordinance of the City of St. Joseph, Missouri, including the prohibition against gratuities and kickbacks set forth below. Any violation of the Purchasing Ordinance subjects the violator to the penalties set forth therein including debarment or suspension. Gratuities. It shall be unethical for any person to offer, give, or agree to give any employee or former employee of the City, or for any employee or former employee of the City to solicit, demand, accept, or agree to accept from another person, a gratuity or an offer of employment in connection with any decision, approval, disapproval, recommendation, preparation or any part of a program requirement or a purchase request, influencing the content of any specification or procurement standard, rendering of advice, investigation, auditing, or in any other advisory capacity in any proceeding or application, request for filing, determination, claim or controversy, or other particular matter, pertaining to any program requirement or a contract or subcontract, or to any solicitation or proposal therefor. Kickbacks.
