Description | Each bid must be accompanied by a Bid Bond along with its Power Attorney prepared on the form attached to the Construction Contract as Appendix C or a Certified Check of the Bidder, in the amount of five (5%) percent of the Bid Amount, duly executed by the Bidder as principal, and having as Surety thereon a company authorized to do business in New York State and its Power Attorney approved by the SCA. Immediately upon receipt of Notice of Intent to Award Letter/Signature Page to the Construction Contract, the successful Bidder shall furnish to the SCA and maintain during the term of the contract, at its own cost and expense a Construction Performance Bond in an amount at least equal to one hundred (100%) percent of the contract price as security for faithful performance of the Contract; and a Labor and Material Payment Bond in an amount at least equal to one hundred (100%) percent of the Contract price for the payment of all persons performing labor on the project under the contract or furnishing materials in connection with the Contract. The surety on such bonds shall be a company listed on the Department of the Treasury's Listing of Approved Sureties, authorized to do business in the State of New York and approved by the SCA. Subject to the SCAs right to reject all bids, the award of the Contract shall be made to the responsible pre-qualified Bidder submitting the lowest responsive bid.
