Description

The Project is located in the Canistota city limits and includes the following Work: Reconstruction of the streets and utilities. Estimated quantities include 3,500 Tons of Asphalt, 9,340 Ft of Curb and Gutter, 4,300 Ft of Watermain, 3,380 Ft of Sanitary Sewer and 4,060 Ft of Storm Sewer. Notice is hereby given that at 7:00 P.M. on August 1, 2022 at City of Canistota, 228 Main Street, Canistota, South Dakota, the City Clerk of City of Canistota, SD, will consider the construction bids received and will either award a contract, reject all bids, or adjourn thereon to a subsequent meeting of the City. The Agency has to concur in the award before the Owner can issue the Notice of Award for the project. Bids are requested for the following Contract: Phase III Infrastructure Improvements Canistota, SD The Project has an expected duration of 120 working days and final completion by November 1, 2023. Work on the improvement shall commence on or after the date specified in the written Notice to Proceed. Bidding Documents may be downloaded from the designated website. Prospective Bidders are urged to register with the designated website as a plan holder, even if Bidding Documents are obtained from a plan room or source other than the designated website in either electronic or paper format. The designated website will be updated periodically with addenda, lists of registered plan holders, reports, and other information relevant to submitting a Bid for the Project. All official notifications, addenda, and other Bidding Documents will be offered only through the designated website. Neither Owner nor Engineer will be responsible for Bidding Documents, including addenda, if any, obtained from sources other than the designated website. Additionally, in accordance with South Dakota Codified Law 5-18B-1, one copy of Plans and Specifications shall be furnished, without charge, to each Contractor resident in South Dakota who intends, in good faith, to bid upon the project. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including addenda, if any, obtained from sources other than the Issuing Office. The successful bidder including any contractors on the project, must be registered in SAM (System for Award Management). Instructions to Bidders For all further requirements regarding bid submittal, qualifications, procedures, and contract award, refer to the Instructions to Bidders that are included in the Bidding Documents. Bidders on this work will be required to comply with Title 40 CFR 33 and Executive Order 12138. The requirements for bidders and contractors under this regulation which concerns utilization of Disadvantaged/Minority Business Enterprises (DBE/MBE) and Women's Business Enterprises (WBE) are explained in the specifications. The DBE/MBE and WBE goals for participation in this contract in terms of percentage of contract value are as follows: MBE 1.0 percent; WBE 4.0 percent. The low responsive bidder will be required to certify to compliance with the American Iron and Steel provision of the Consolidated Appropriations Act of 2014. This certification form may be found on page AIS-21 of the State Revolving Fund (SRF) General Conditions and must be included in the bid proposal. Please be advised that waivers or exemptions from the American Iron and Steel provision that cite International Trade Agreements DO NOT comply with the Consolidated Appropriations Act of 2014 as it applies to the SRF programs. Claims from suppliers that the American Iron and Steel provision does not apply to certain products based on the International Trade Agreement exemptions of the Consolidated Appropriations Act of 2014 will not be accepted. Davis Bacon and Related Acts wages apply to this project. All provisions relative to those acts must be met. The successful bidder including any contractors on the project, must be registered in SAM (System for Award Management). Your special attention is invited to the attached DBE Subcontractor Solicitation Information form, DBE Subcontractor Performance Form, DBE Subcontractor Utilization Form, Certification Regarding Debarment, Suspension and Other Responsibility Matters (Debar) form, American Iron and Steel Certification. These forms must be completed and submitted with your bid proposal. Failure to submit these forms may be cause for the bid to be rejected. Please be advised that good-faith efforts will be subjected to close scrutiny and if the good-faith effort submission is unacceptable, your bid will be rejected. Construction Services in South Dakota are subject to tax under SDCL 10-46A. Contractors shall include the applicable tax in their bid price for each item of work. Tax questions should be directed to the South Dakota Department of Revenue at 800-829-9188. Each bid must be accompanied by bid security payable to the Owner for five (5%) percent of the total amount of the Bid as a certified or bank check issued by a State or National bank or ten percent (10%) as a bidders bond. With submittal of a Bid, the Bidder represents that he has visited the site, familiarized himself with the local conditions under which the work is to be performed, and correlated his observations with the requirements of the Contract Documents. The Owner reserves the right to reject any and all bids or to accept any bid. Bidder's Proposal shall hold firm for thirty (30) days from the date of opening. Mutually agreed upon extensions of time may be made, if necessary. Nondiscrimination in Employment Bidders on this work will be required to comply with the Presidents Executive Order Nos. 11246 as amended, 11518, and 11625 as amended. The requirements for bidders and contractors under these orders are explained in the specifications. The low responsive bidder must assure compliance with the requirements of Public Law 115-232, Section 889, Prohibition on Certain Telecommunications and Video Surveillance Services or Equipment. This project may be partially funded using American Rescue Plan Act (ARPA) funds. As a condition of the ARPA funding guidelines, the Contractor is shall meet the following minimum requirements: 1. Based on the Build America, Buy America provisions of the Infrastructure Investment and Jobs Act (IIJA) and E.O. 14005 which provide that, as appropriate and to the extent consistent with law, a preference will be provided to Contractors for the purchase, acquisition, or use of goods, products, or materials produced in the United States (including but not limited to non-iron and steel metals, lumber, cement, and other manufactured products.) The Contractor shall provide documentation of their efforts to meet the provisions of Build America, Buy America upon request. For all further requirements regarding bid submittal, qualifications, procedures, and contract award, refer to the Instructions to Bidders that are included in the Bidding Documents.
