Description

The North Hudson Sewerage Authority Boulevard East Combined Sewer Improvements work includes furnishing all labor, materials, and equipment necessary to complete the Work as shown on the Drawings and as described in the Specifications. The work generally consists of upsizing combined sewer pipes along Hamilton Avenue and Boulevard East, installing new high-level storm sewers along Hamilton Avenue, Highwood Avenue, and Hudson Place, constructing a stormwater pumping station, installing a force main to convey stormwater from the pump station to the combined sewer on Boulevard East, and all excavation, stone foundation and pipe bedding, backfill, compaction, site restoration, dewatering, and other work necessary to complete the project. Work will also include coordination with utility companies providing service to the newly constructed works. Bid security shall be furnished in accordance with the Instructions to Bidders. The Owner will evaluate bids and any award will be made to the lowest, responsive, responsible bidder in accordance with N.J.S.A. 40A:11-4. The Owner reserves the right to reject any or all bids and to waive minor informalities or irregularities in bids received in accordance with applicable law. The qualification and reclassification of bidders will be subject to the statutory provisions contained in Local Public Contracts Law. Bidders are required to comply with all relevant Federal and State Statutes, Rules and Regulations including but not limited to the applicable provisions of Title VI of the Civil Rights Act of 1964, as amended (42 USC 2000d 2000D 4A), the discrimination and affirmative action provisions of N.J.S.A. 10:2 1 through 10:2 4, the New Jersey Law against Discrimination, N.J.S.A. 10:5 1, et seq., the rules and regulations promulgated pursuant thereto, the State requirement for bidders to supply statements of ownership (N.J.S.A. 52:25 24.2) and the State requirement for submission of the names and addresses of certain subcontractors (N.J.S.A. 40A:11 16). The Contract is expected to be funded in part with the funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the United States nor the State of New Jersey, the New Jersey Environmental Infrastructure Trust, nor any of their departments, agencies, or employees is, or will be, a party to the Contract or any lower tier contract or subcontract. The Contract or Subcontract will be subject to regulations contained in N.J.A.C. 7:22-3.1 et seq., 4.1 et seq., 5.1 et seq., 9.1 et seq. and 10 et seq., Local Public Contract, Department of Labor Current Wage Rate Determination, Prevailing Wage Act, Contract Work Hours and Safety Standard Act, Copland Act, Davis Bacon Act, Buy American Clause, Debarment and Suspension, and Socially and Economically Disadvantaged (SED) (N.A.J.C. 7:22-9).All bids shall include a commitment to the use of small, minority, women's and labor surplus area businesses and shall be in conformity with N.J.A.C. 7:22-3.17(a)(24) with a goal of not less than 10% participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SED's). Further details regarding required SED participation are included in the Information for Bidders and the Supplemental General Conditions. Pursuant to N.J.S.A. 52:32-44 all business organizations that conduct business with a New Jersey government agency are required to be registered with the State of New Jersey. Bidders and their subcontractors must submit proof that they are registered with the New Jersey Department of Treasury, Division of Revenue by submitting a copy of their Business Registration Certificate prior to Contract award. Pursuant to N.J.S.A. 10:5 31 et seq., bidders are required to comply with the requirements of P.L. 1975 c. 127, NJAC 17:27. Each Bidder must submit with his bid an "Ownership Disclosure Statement" and is requested to submit with his bid the "Non-Collusion Affidavit" on the forms included in the Contract Documents. Bidders and their subcontractors of any tier must comply with all applicable provisions of the Public Works Contractor Registration Act (N.J.S.A. 34:11-56.48) and the New Jersey Prevailing Wage Act (N.J.S.A. 34:11-56.25). Bidders will be subject to penalties for falsification in accordance with the statutory provisions contained in N.J.S.A. 40A:11-33 to 34 (Local Public Contracts Law). It is the purpose of this Notice to Bidders to summarize some of the more important provisions of the Contract Documents. Prospective bidders are cautioned not to rely solely on this summary, but to read the Contract Documents in their entirety.
