Description | Lincoln Electric System is requesting bids to furnish and deliver FOB, Lincoln, Nebraska, the specified fiberglass street light poles included in this bid solicitation. Each bid must include the full name and business address of the bidder and be legibly signed by the bidder. A bid by a firm or organization other than a corporation must include the name and address of each member. A bid by a corporation must be signed in the name of such corporation by an official authorized by the corporation to sign the bid. Any person signing a bid for a firm, corporation, or other organization may be required to show evidence of his/her authority to bind the firm, corporation, or organization. Each bidder shall submit as a part of the bid complete specifications and descriptive matter describing the work to be performed and a description of the equipment or other merchandise he/she proposes to furnish, including in the description such items as design, form, capacity, principles of operation, details of construction, materials used, workmanship, and guarantees of performance. The specifications and descriptive matter not in conflict with LES specifications shall be considered part of the conditions of the offer submitted by the bidder. Communications and technical questions concerning this Bid shall be submitted using the LES Online Procurement System. Each bidder shall state in their bid the date upon which they can make delivery of all equipment or other merchandise bid. The time required for such delivery is hereby made an essential element of the contract. Unless LES specifications provide otherwise, each bidder shall guarantee in their bid any new or used equipment or other merchandise to be furnished against mechanical and physical defects for a period of time to be stated by the bidder, dating from the date of delivery of the equipment or merchandise to LES, and to replace without charge any parts or portions of the equipment proven defective under ordinary service during such period. If the bidder fails to include any guarantees in the bid, the bidder shall be considered to be a merchant giving an implied warranty under Section 2-314 and section 2-315 of Nebraska's Uniform Commercial Code. Any implied warranty shall not, however, modify any express warranty arising from the submission or acceptance of any plans or specifications made a part of the bid. |
