Description

The project includes: Replacement of boilers at Babb Elementary School, located at 4150 US-89. All bids for the construction of any public contract project shall contain a statement showing that the bidder or contractor is duly registered under the laws of the State of Montana, and the number of such registration shall appear upon such bid or proposal, and no contract shall be awarded to any contractor unless he is the holder of a registration. All laborers and mechanics employed by contractors or subcontractors in performance of the construction work shall be paid wages at the rates required under federal Davis-Bacon prevailing wage law. Subject to the Indian preference requirements attendant to the procurement of these construction services as noted below, the Contractor must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex, or national origin. Each bid must be accompanied by bid security in the amount of ten percent (10%) of the bid and in one or more of the acceptable forms of security listed in 18-2- 302(2), MCA. Successful bidders shall be required to provide performance, payment and materials security in the amount of one hundred percent (100%) of the full contract amount and in one or more of the acceptable forms of security listed in 18-2-201, MCA and to provide insurance and insurance documentation as required by the specifications and contract documents No bid shall be withdrawn after the scheduled time for the public opening of the bids. Browning School District No. 9 reserves the right to reject any or all bids received, to waive informalities, to postpone the award of the contract for a period of not to exceed sixty 60) days, and to accept the bid Schedule and/or Schedules which are in the best interest of the Owner. The funding for this project may consist in whole or in part of federal education funds received under 20 U.S.C. 7701 et seq. [Impact Aid] and, in accordance with the requirements of 25 U.S.C. 450e [Indian Self-Determination and Education Assistance Act], the procurement of construction services for this project will be subject to a PREFERENCE for qualified Indian organizations or Indian-owned economic enterprises. In addition to any Indian preference requirements, the Contractor shall meet all requirements of Blackfeet TERO and Tribal Revenue and shall include the price of a Montana State Building Permit in its bid. State of Montana Gross Receipts Tax of one percent (1%) will be deducted from the Contractor's payments. The State fee for plan review shall be paid by the Browning Public School District.
