Description

For Preventative Maintenance for Kitchen Hood Exhaust Cleaning This work is estimated by the Department of Administration, Public Works Division to be less than $150,000.00.Bid must comply with the below listed requirements and utilize DAPW Form 35. Prequalification is not required. INDIVIDUAL QUOTATIONS MAY BE REJECTED BY THE DIRECTOR OF PUBLIC WORKS FOR THE FOLLOWING REASONS (25 IAC 2-6-5) The Contractor and its employees and subcontractors shall comply with all applicable licensing standards, certification standards, accrediting standards and any other laws, rules or regulations governing services to be provided by the Contractor pursuant to this Contract. The State shall not be required to pay the Contractor for any services performed when the Contractor, its employees or subcontractors are not in compliance with such applicable standards, laws, rules or regulations. If licensure, certification or accreditation expires or is revoked, or if disciplinary action is taken against the applicable licensure, certification or accreditation, the Contractor shall notify the State immediately and the State, at its option, may immediately terminate this Contract. No right conferred on either party under this Contract shall be deemed waived, and nobreach of this Contract excused, unless such waiver is in writing and signed by the party claimed to have waivedsuch right. Neither the State's review, approval or acceptance of, nor payment for, the services required under thisContract shall be construed to operate as a waiver of any rights under this Contract or of any cause of action arisingout of the performance of this Contract, and the Contractor shall be and remain liable to the State in accordance withapplicable law for all damages to the State caused by the Contractor's negligent performance of any of the servicesfurnished under this Contract. The State of Indiana may, but is not obligated to, offer this contract with the same terms and conditions except price each year for an additional three (3) years upon mutual agreement of all parties. An adjustment of the annual contract amount may be made at the end of each year this agreement is in force. The first year of the Agreement shall begin March 1, 2023 The length of the agreement is three hundred and sixty-five (365) days and is renewal upon concurrence of all parties for an additional three (3) contract years
