Description | Any inquiries or requests regarding clarification of this procurement document shall be submitted to the Procurement Officer in writing. Offerors may contact ONLY the Procurement Officer regarding the terminology stated in the procurement document. Other County employees do not have the authority to respond on behalf of the County. Dona Ana County Flood Commission was established in accordance with the New Mexico State Statutes, Sections 4-50-1 through 4-50-9 NMSA 1978. Since January 1988, the Flood Commission has been working on the maintenance, repair and upgrade of many existing flood control structures. More recently, new flood control structures have been constructed in different areas of the county. Other projects are being developed and will be implemented as funding becomes available. The County intends to enter into multiple agreements with the successful Proposers for the Maintenance and repair offlood control structures projects. Work will be accomplished by issuing a Task Order under the Price Agreement. Liquidated damages will be assessed per day for each calendar day that substantial completion exceeds the task order time. The amount of days allowed until substantial completion and liquidated damages, amounts will be determined per task order. The awarded contractor(s) shall furnish all management, documentation, labor, materials and equipment needed to perform the work. The term of this contract shall be one (1) year with an option to renew by mutual consent for two (2) additional one (1) year periods. The County may add to or delete from the Scope of Work set forth in this RFP. No purchases are obligated by this request for proposals. Pursuant to Section 13-1-154.1 (B) of the State of New Mexico Procurement Code the total amount of each contract and all renewals shall not exceed twelve million five hundred thousand dollars ($12,500,000.00) over three (3) years and any one Task Order/Purchase Order shall not exceed four million dollars ($4,000,000.00). The County may award up to three (3) Construction contracts through this solicitation. Proposers must be licensed as contractors in the State of New Mexico as required by State statute and must include license number in the prescribed place on the proposal form. Each unit price schedule must be submitted on the prescribed form. The County reserves the right to accept or reject any and/or all proposals, to waive irregularities and technicalities, and to request resubmission. Any sole response that is received may or may not be rejected by the County depending on available competition and timely needs of the County. The County reserves the right to award the contract to the responsible proposers submitting responsive proposals with resulting agreements most advantageous and in the best interest of the County. It is the responsibility of each subcontractor submitting a proposal to a contractor to be prepared to submit a faithful performance and payment bond if requested by the contractor. |
