Description

The work includes, but is not limited to, modifications to existing diversion structures and the existing Excess Flow clarifier, construction of a new flow control structure, the construction of a new swirl concentrator, construction of new duplex pump stations, and the corresponding piping, electrical, and sitework necessary to complete the work. The work shall also include but not be limited to excavation, bedding, haunching, backfilling, compacting, paving, surface restoration, and erosion/sedimentation control. Alternate 1: CSO Headworks Building Improvements Alternate 2: Demo Existing Clarifiers Alternate 3: Excess Flow Clarifier Bridges Alternate 4: Rehabilitation of 60" Excess Flow Clarifier Pipe Alternate 5: Excess Flow Clarifier Grout Alternate 6: Remove & Replace Excess Flow Clarifier Drain Alternate 7: Remove & Replace Excess Flow Clarifier Drain Pump Station Bid Security shall be made payable to OWNER, in an amount of ten percent (10%) of the Bidder's maximum Base Bid price and in the form of a certified or bank cashier's check or a Bid Bond issued by a surety meeting the requirements of Article 6.01 of the General Conditions and executed on the form included as Document 00 43 13 - Bid Bond As required by the award conditions of USEPA's Assistance Agreement with IEPA, all sub-agreements of the prime contractor must identify that the fair share percentages are 5% for MBEs and 12 % for WBEs. Owner reserves the right to reject any of the following: 1. Any Bid submitted after the date and time specified in the Advertisement for Bids. 2. Any Bid determined by Owner to be not a Responsible Bid. 3. Any Bid determined by Owner to be not a Responsive Bid. 4. Any Bid determined by Owner to be a conditional or qualified Bid. 5. All Bids. B. Discrepancies between words and figures will be resolved in favor of words. Discrepancies between the indicated sum of any column of figures and the correct sum thereof will be resolved in favor of the correct sum. C. In evaluating Bids, OWNER shall consider the qualifications of the Bidders, whether or not the Bids comply with the prescribed requirements, and alternates and unit prices if requested in the Bid forms. It is OWNER's intent to accept alternates listed on the Bid Form (if any are accepted) in any order or combination. D. OWNER may consider the qualifications and experience of Subcontractors and other persons and organizations (including those who are to furnish the principal items of material or equipment) proposed for those portions of the Work as to which the identity of Subcontractors and other persons and organizations must be submitted as provided in the Supplementary Conditions or Specifications. Operating costs, maintenance considerations, performance data and guarantees of materials and equipment may also be considered by OWNER. E. OWNER may conduct such investigations as he deems necessary to assist in the evaluation of any Bid and to establish the responsibility, qualifications and financial ability of the Bidders, proposed Subcontractors and other persons and organizations to do the Work in accordance with the Contract Documents to OWNER's satisfaction within the prescribed time. F. OWNER reserves the right to reject the Bid of any Bidder who does not pass any such evaluation to OWNER's satisfaction. G. If the Contract is to be awarded, it will be awarded to the low, responsive, responsible Bidder, based on the Total Lump Sum Base Bid price. Contract will be awarded after the Bid evaluation has been submitted to the Agency and Owner has received written notice of Agency approval of the award. H. If the Contract is to be awarded, OWNER will give the Successful Bidder a Notice of Award as identified in Document 00 41 00, Section 1.02. I. All applicable laws, ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the Project shall apply to the Contract throughout including the Act regulating wages in Illinois (Ill. Rev. Stat. Ch. 48, Sects 39s-1-12) and the Illinois Preference Act (Ill. Rev. Stat. Ch. 48, Sects 2201-2207). J. Should there be reasons why the Contract cannot be awarded within the specified period, the time may be extended by mutual agreement between Owner and the Bidder . 1. Manufacturer certified according to NRMCA's "Certification of Ready Mixed Concrete Production Facilities." 2. Engineer reserves the right to reject Manufacturer at any time and to require Contractor to obtain different supplier. Bidder accepts the provisions of the Agreement and Supplementary Conditions as to liquidated damages. BIDDER accepts the provisions of the Agreement as to liquidated damages in the event of failure to complete the Work on time. OWNER and CONTRACTOR recognize that time is of the essence of this Agreement and that OWNER will suffer financial loss if the Work is not substantially complete within the time specified in paragraph 3.1 above, plus any extensions thereof allowed in accordance with Article 12 of the General Conditions. They also recognize the delays, expense and difficulties involved in proving in a legal or arbitration proceeding the actual loss suffered by OWNER if the Work is not substantially complete on time. Accordingly, instead of requiring any such proof, OWNER and CONTRACTOR agree that as liquidated damages for delay (but not as a penalty) CONTRACTOR shall pay OWNER an amount as set forth in SUPPLEMENTARY CONDITIONS for each day that expires after the time specified in paragraph 3.1 for substantial completion until the Work is substantially complete . Electronic copies of the Bidding Documents may be obtained from the issuing office Monday through Friday between the hours of 8:00 a.m. and 5:00 p.m. (local time). Electronic copies of documents may be obtained free of charge. Bid security shall be furnished in accordance with the Instructions to Bidders.
