Description | Each bid must contain the full name of the party or parties submitting the proposal and all persons interested therein and be accompanied by a certified check on some solvent bank or bid bond in the amount of $1,500.00 as a guarantee that if the bid is accepted, a contract will be entered into and its performance properly secured (Business Services Bond/Performance Bond $100,000.00). Should any bid be rejected, such check will be forthwith returned to the bidders. Should any bid be accepted, such check will be returned upon proper execution and securing of said contract. BIDDERS MUST USE ATTACHED BID SHEET FOR RESPONSE. BID BOND OR CERTIFIED CHECK MUST BE ATTACHED TO THE FRONT COVER OF THIS SPECIFICATION BOOK. This signed bid shall be considered an offer on the part of the bidder, which offer shall be deemed accepted upon approval by the City Board of Control within 30 days of the bid, or the issuance of a purchase order, and in case of a default on the part of the bidder after such acceptance, the City of Barberton, Ohio, may take such action as it deems appropriate, including legal action for damages or specific performance. Failure to comply with bid deposit or check requirements as stated in the bid documents shall be considered a material deviation and shall mean that the City shall reject any non-complying bids. Each bidder must ensure that all employees and applicants for employment are not discriminated against because of their race, creed, color, sex, national origin, or disability under the Americans with Disabilities Act. The City reserves the right to reject any and all bids and to award the contract to the lowest and best bidder. Prospective bidders will note that the Board of Control has the discretion to make the final award. |
