Description

Bidders and/or authorized agents are invited to be present. All information submitted with the bid is public information and may be subject to disclosure. The general nature of work consists of furnishing all labor, material, equipment, services, and incidentals required by the Plans, Specifications, and contract documents. The general items of work for the construction of the new civic plaza and park include the relandscaping of city hall plaza, closure of Maine Ave between Pacific Ave and Sterling Way, the addition of new pavilion with seating and water feature, a new retail building with parking, and new park signage. Work includes removal of existing improvements, grading and compaction, construction of new asphalt concrete and concrete pavement, asphalt concrete overlay, construction of sidewalk, landscaping and landscape irrigation, removal and replacement of park trees, signage, marking, curb painting. Other work includes construction of new retail building, pavilion, and water feature with concrete, masonry, metal, and wood related work, new plumbing, electrical, heating, ventilation, and air-conditioning, and providing new utility connections for gas, water, electrical, sewer, and communications. Related work includes construction surveying and staking, traffic control and all appurtenant work. The bid items, corresponding estimated quantities, and the time allowed to complete the work are listed in the Proposal. The descriptions of bid items are defined in the Technical Provisions. Proposals Bids shall be sealed and plainly marked Sealed Bid for Susan Rubio Zocalo Park and Civic Center Plaza Project Bids must be prepared using the Contractor s Bid Proposal forms and all the other forms identified in the Instructions to Bidders. The forms required to complete a bid package are found in Contract Documents. No bids will be accepted if not submitted using the approved forms. The Information to Bidders provides prospective bidders a summary of requirements for acceptance of bids, guidelines the City uses in awarding contracts, rules to ensure fairness in contractor procurement and guidelines to aid in interpretation of documents. The Construction Contract / Agreement define the Contract Documents which serve to control construction, work performed, and materials furnished, and includes the Specifications and Plans. Each bid must be accompanied by cash, certified check, cashier s check, or bidder s bond made payable to the City of Baldwin Park or issued by a surety admitted to do business in California, for an amount equal to at least ten percent (10%) of the amount of bid. Such guaranty to be forfeited to the City of Baldwin Park should the bidder to whom the contract is awarded fail to enter into the contract. The City of Baldwin Park reserves the right to reject any and all bids for any reason and to waive any minor irregularities in the bid documents at the discretion of the Director of Public Works. Bidders may not withdraw their bid for a period of sixty (60) days after the opening date. City Business License, Contractors License and Permit Prior to contract execution, the contractor and his/her subcontractors shall obtain a City of Baldwin Park business license. Completion- (70) working days In accordance with provisions of Section 3300 of the California Public Contract Code, the City has determined that the Contractor shall possess a valid Class A California Contractor's License or other appropriate license classification under the State Contracting Code at the time the contract is bid. Failure to possess such license may render the bid non-responsive. The successful bidder will be required to obtain a City encroachment permit to work in public right- of-way, issued at no fee for the project. Prevailing Wages In accordance with the provisions of Sections 1770 et seq., of the Labor Code, the Director of the Industrial Relations of the State of California has determined the general prevailing rate of wages applicable to the work to be done. The Contractor will be required to pay to all persons employed on the project by the Contractor sums not less than the sums set forth in the documents entitled General Prevailing Wage Determination made by the Director of Industrial Relations pursuant to California Labor Code, Part 7, Chapter 1, Article 2, Sections 1770, 1773, 1773.1. These documents can be reviewed in the office of the City Clerk or may be obtained from the State. The following Labor Code sections are made a part of the contract and will be applicable to the work to be done: Contractor s Registration In accordance with Labor Code Section 1771.1, a contractor or subcontractor shall not be qualified to (a) bid on or be listed in a bid proposal on or after March 1, 2015 or (b) engage in the performance of this Work after April 1, 2015 unless currently registered with he Department of Industrial Relations and qualified to perform the Work pursuant to labor Code Section 1725.5. Compliance Monitoring and Enforcement Contractor s performance of the Work described in this Notice Inviting Bids is subject to compliance monitoring and enforcement by the California Department of Industrial Relations. Equivalent Securities Pursuant to California Public Contract Code Section 22300, substitution of eligible and equivalent securities for any moneys withheld to ensure performance under the contract for the work to be performed will be permitted at the request and expense of the successful bidder, unless otherwise prohibited by law.
