Description

Attention is called to the provisions for Equal Employment Opportunity. This Contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, which provides that training, employment and other economic opportunities generated by HUD assistance or HUD-assisted projects covered by Section 3, shall, to the greatest extent feasible, be directed to low- and very low-income persons, particularly persons who are recipients of HUD assistance for housing. All bidders are to review the General Conditions section. The prospective contractors are urged to visit the site to familiarize themselves with the site conditions and review the "Scope of Work". All bids shall be accompanied by a certified check or a Bid Bond made payable to the Wilkes-Barre Housing Authority with corporate surety in an amount of not less than five percent (5%) of the Bid as a guarantee that the bidder will execute the Contract if awarded the same. The surety Bond, Bid Bond and the attorney-in-fact that executes the Bond on behalf of the surety shall affix to the Bond a certified and current copy of the Power-of-Attorney. If the bid is not accepted, the Bid will be returned to the Bidder. In the event the Bidder fails, within ten (10) days after Notice of Award, to sign the contract or fails to comply with the bonding or insurance requirements hereinafter stated, the good faith deposit (BID BOND) shall be forfeited to the Housing Authority as Liquidated Damages. Within ten (10) days after the Notice of Award, the successful bidder shall execute the Agreement between the Authority and the Contractor. The successful bidder shall deliver a Certificate of Insurance in amounts specified at the time of the execution of the contract. If any person contemplating submitting a Bid for the performance of the work is in doubt as to the true meaning of any part of the Contract Documents, he/she may submit to the Authority a written request for interpretation thereof no later than five (5) days before bids will be opened. The person submitting the request shall be responsible for its prompt delivery. Interpretations or corrections of proposed Contract Documents will be made only by addendum and will be mailed or delivered to each Bidder of Record. The Owner will be responsible for any other explanations or interpretations of the proposed Contract Documents. No Bid will be considered which fails in any respect to comply with the terms of the Bid Conditions and Contract Documents. The Authority reserves the right to reject any or all Bids and to waive any informalities in the bidding. No Bid shall be withdrawn for a period of Sixty (60) days subsequent to the opening of Bids without the consent of the Authority. Wilkes-Barre Housing Authority is an Equal Opportunity Employer
