Perina mperina@nasboces.org (516) 396-2240 Nassau BOCES 71 Clinton Road Garden City, NY 11030 The purpose of this bid is to establish price, design and installation parameters for the establishment of Fiber Optic Carrier Wide Area Networks (WAN's) for the school districts listed in Section 1.10, Site Locations. Towards that end, BOCES proposes to award to those lowest responsible bidder(s) agreements for these services. Sealed bids will be received until 12:00 p.m. on the date indicated for bid opening at the Business Office located at 71 Clinton Road, Garden City, New York, at which time they will be publicly opened and read. All proposals shall be based upon the information contained in the specifications and any addenda issued during the bid period. The successful bidder will be required to show to the Owner that he is carrying Workmen's Compensation Insurance as required by law, and all other insurance specified. PERIOD COVERED: The Fiber Optic Carrier WAN's must be entirely operational by the dates indicated for each district in Section 1.10, Site Locations and maintained for a period of 36 months or 60 months, in accordance with bid specifications, Board approved award and execution of contract. ESTIMATED EXPENDITURES: BOCES reserves the right to order only those services for which a genuine need exists and for which funds are available. Conversely, additional services may also be ordered at the bid price, as needs dictate, for the term of the agreement. BAIT AND SWITCH: The practice of bait & switch may have been an acceptable practice in the past; it is not acceptable here. Evidence that a vendor engages in such a practice will be met with remedies available to BOCES as previously stated in this bid and/or provided for under the Uniform Commercial Code of this State. Vendors who have a history of bait & switch, poor delivery, or failure to comply with the general intent of bids generated by BOCES may be precluded from future bid participation. SUBSTITUTION: Materials delivered as a result of the acceptance of this bid shall be in total conformance with all specifications as originally written or as accepted when an equal is offered by the bidder. No substitution (witting or unwitting) will be allowed which has not been reviewed and accepted by the Board at the time of award as an approved equal. The practice of substitution after acceptance is grounds for breach of contract. VENDOR ASSISTANCE: The successful bidder shall provide, upon request, copies of current price books or catalogs to any participant regarding products awarded by BOCES. Photocopies will be accepted in lieu of originals. SUB-CONTRACTORS LISTING: The successful bidder shall be required to submit for approval, a listing of all sub-contractors whose services it proposes to employ on the project, no later than ten (10) days after the signing of the contracts. Nassau BOCES' approval of sub-contractors will not be unreasonably withheld. The decision of the Purchasing Agent shall be final and conclusive regarding the approval or rejection of sub-contractors. |
