Description | The time for preparing bids shall be a minimum of 10 days from Notice to Bidders to receipt of Bids. This project is funded in part by the New Jersey Environmental Infrastructure Trust Program and the successful Bidder must comply with all the provisions of N.J.A.C. 7:22-9.1 et seq. for the participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SED). The proposed project includes the demolition of the existing Lafayette Pump Station located at Block 94, Lot 9 in Carneys Point Township. The existing sanitary flows will be redirected through a proposed sanitary collection system consisting of approximately 1,600 LF 8" PVC pipe, 150 LF 10" PVC pipe, and 9 new manholes. The collection system is proposed to be constructed within portions of Lafayette Road, Market Street, and Georgetown Road (CR 629), and ultimately connects to an existing manhole within the intersection of Laurel Road and Polk Avenue. The project includes work necessary to reconnect residences to the proposed collection system. Abandonment and demolition of the existing sanitary mains and manholes is also included within the scope of work. This project is being bid in accordance with local public contract bid laws and Bidders shall comply with the Local Contracts Law, N.J.S.A. 40A:11-1 et seq. Bids must be submitted on the forms provided within the documents in the manner designated therein. Bids must be enclosed in a sealed envelope bearing the bidder's name and address labeled "BID FOR CONSTRUCTION OF LAFAYETTE ROAD SANITARY SEWER PROJECT" and addressed to the Carneys Point Township Sewerage Authority, 303 Harding Highway, Carneys Point, NJ 08069, Attention: Patricia Willis, CPTSA Business Manager. If forwarded by mail, the sealed envelopes containing the bid must be enclosed in another envelope addressed to the Carneys Point Township Sewerage Authority. Bids must be accompanied by a Certificate of Surety from an acceptable surety and a bid security in the form of a certified check, cashier's check, or bid bond payable to the Carneys Point Township Sewerage Authority. Refer to N.J.S.A. 40A:11-21 for bid bond requirement. A person bidding on a contract for the erection, alteration or repair of a public building, structure, facility or other improvement to real property, the total price of which exceeds $100,000, shall furnish a guarantee as provided for herein. A contracting unit may provide that a person bidding on any other contract, advertised in accordance with law, shall furnish a guarantee as provided for herein. The guarantee shall be payable to the contracting unit so that if the contract is awarded to the bidder, the bidder will enter into a contract therefor and will furnish any performance bond or other security required as a guarantee or indemnification. The guarantee shall be in the amount of 10% of the bid, but not in excess of $20,000.00, except as otherwise provided herein, and may be given, at the option of the bidder, by certified check, cashier's check or bid bond. In the event that any law or regulation of the United States imposes any condition upon the awarding of a monetary grant to any contracting unit, which condition requires the depositing of a guarantee in an amount other than 10% of the bid or in excess of $20,000.00 the provisions of this section shall not apply and the requirements of the law or regulation of the United States shall govern. The Contracts, if awarded, will be to the lowest responsible bidder whose bid proposal conforms to the requirements set forth in the Contract Documents. The Carneys Point Township Sewerage Authority will award the Contract or reject the bids within sixty (60) calendar days after the date of the bid opening. Should there be any reason the contract cannot be awarded within the specified period, the time may be extended by mutual agreement between the Carneys Point Township Sewerage Authority and the bidder. All bidders are required to provide a copy of the contractors and subcontractors business registration certificate(s) issued by the Department of the Treasury in accordance with Section 1 of P.L. 2004, c.57 (C.52:32-44). All Contractors and subcontractors must also comply with the "Public Works Contractor Registration Act" (P.L. 2203, c.91); and P.L. 1977, c.33 (Disclosure of Ownership). The successful bidder shall also comply with the provisions of the New Jersey Prevailing Wage Act, Chapter 150 of the Laws of 1963, effective January 1, 1964. The successful bidder must furnish a Performance Bond and Payment Bond, each in the amount equal to one hundred percent (100%) of the contract price. Said bonds must be in a form acceptable to the Carneys Point Township Sewerage Authority and be issued by a surety authorized to do business in the State of New Jersey. All applicable surety bonds required in connection with the advertisement and award of building contracts or subagreements must be written by a surety company listed on the Federal Treasury List (Department Circular 570Surety Companies Acceptable on Federal Bonds), incorporated herein by reference. Copies of this document may be obtained from the Department. Pursuant to N.J.A.C. 10:5-33: "Bidders are required to comply with the requirements of P.L.1975, c.127." This includes compliance with Affirmative Action requirements pursuant to Public Law 1975 C. 127 (N.J.A.C. 17:27) as revised and amended to date. The successful Bidder must also furnish an Initial Project Manning Report (AA201) upon execution of the Agreement. The contract shall not be approved until a favorable eligibility determination has been made by the NJDEP per requirements of the New Jersey Environmental Infrastructure Trust. Contractor is advised of the responsibility to file an annual disclosure statement on political contributions with the New Jersey Election Law Enforcement Commission pursuant to N.J.S.A. 19:44A-20.13 (P.L. 2005, c271, s3) if the contractor receives contracts in excess of $50,000.00 from public entities in a calendar year. It is the Contractor's responsibility to determine if filing is necessary. Additional information on this requirement is available from ELEC at 888-313-3532 or at www.elec.state.nj.us. This contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Infrastructure Bank. Neither the State of New Jersey, the New Jersey Infrastructure Bank nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10. In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a)24 and 4.17(a)24, the contractor (subcontractor) shall comply with all of the provisions of N.J.A.C. 7:22-9. |
