Description

The Town of Chapel Hill, North Carolina, is requesting statements of qualifications from engineering and/or landscape architect firms (Consultant) interested in providing consulting services for inspections of stormwater control measures (SCMs) at Town-owned facilities as part of the Town's compliance with MS4 requirements. The successful Consultant will demonstrate proficiency in and experience with stormwater control measure (SCM) inspections and reporting, the North Carolina Stormwater Design Manual, and the National Pollutant Discharge Elimination System (NDPES) Stormwater Phase II Rule for Municipal Separate Storm Sewer Systems (MS4) regulations. The Town of Chapel Hill reserves the right to reject any and all statements of qualifications. The Town of Chapel Hill (Town) operates under two different NPDES permits associated with stormwater. Compliance assistance requested in this RFQ is related to the MS4 stormwater permit activities. The MS4 permit requires the Town to implement certain activities to demonstrate compliance with six minimum measures. The Town is seeking compliance assistance with the "Pollution Prevention and Good Housekeeping for Municipal Operations" minimum measure that requires annual and routine inspections of all municipally-owned or maintained structural stormwater control measures (SCMs). See the Town's Stormwater Control Measure website for a copy of O&M Plans that provide information on the required frequency of inspections and associated maintenance activities for each SCM type. Per the Town's O&M requirements for SCMs, annual inspections shall be performed by a qualified licensed Professional Engineer or Landscape Architect, and routine maintenance and inspection shall be performed by a qualified professional with NCSU Stormwater Inspection and Maintenance Certification or similar certification. The Town is seeking compliance assistance with the following activities. A. Initial Inspection for all Town-owned SCMs The Consultant shall conduct initial comprehensive inspections of all Town-owned SCMs within approximately six (6) months from the Notice of Proceed. B. Annual Inspection and Maintenance Report for all SCMs at each Town Facility An Annual Inspection and Maintenance Report shall be submitted to the Town of Chapel Hill Stormwater Management Division for each Town facility. The report shall detail the status of each SCM and any maintenance requirements as outlined in the SCM Inspection Report Guidelines. All report submittals must be delivered via email in a single PDF file. The report package for each Town Facility shall include: 1. Cover Sheet 2. Inspection Report for each SCM 3. Photographs of each SCM with descriptive captions 4. Copies of SCM maintenance records as proof of routine maintenance The report package file name shall follow the naming convention specified in the SCM Inspection Report Guidelines. C. Routine Inspections of all Town-owned SCMs The Consultant shall conduct routine inspections at all Town-owned SCMs after initial inspections are completed, annual reports have been submitted to the Town, and after corrective actions identified in the initial Annual Inspection and Maintenance Report have been completed by the Town or a third party. The timeline for beginning routine inspections may differ among Town facilities depending on the extent of corrective actions needed and the time it takes to complete those actions. The Consultant shall maintain a SCM Inspection and Maintenance Log for each SCM. All inspections shall be recorded in the log according to the frequency in the Town's Stormwater O&M Plan for each SCM and within 24 hours after storm events that exceed 1.0 inch of rainfall. NOTE: The O&M Plan inspection and maintenance provisions for each SCM is not an exhaustive list of all inspection and maintenance tasks that may be required. Please note that e-mailed proposals must be received by the specified deadline according to the internal clock of Town of Chapel Hill's server receiving the proposal. Proposals received after the date and time specified in this RFQ are considered late and shall not be considered, under any circumstances, for any award resulting from this RFQ. Please do not submit paper copies. The Town accepts no responsibility for any expenses incurred in the submittal preparation and presentation, such expense is to be borne exclusively by the Consultant. All materials and documents submitted by the Consultant in response to this Request for Qualifications or any additional requests for materials and documents made by the Town for evaluation pursuant to this Request for Qualifications will become the property of the Town and will not be returned. The selected Consultant shall be responsible for all costs incurred by it during negotiations. The Town will apply the requirements of North Carolina General Statute Section 143-64.31 regarding selection of architectural and engineering services. The Consultant selection will be based on the submitted qualifications information. The Town may have an interview process. Proposals submitted by Consultants will be evaluated according to the following criteria, and the final selection will be the Consultant that provides the best mix of qualifications and experience. o Compliance with the Request for Qualifications Project understanding and proposed approach, schedule, and methodology o Relevant and demonstrated experience/expertise with similar projects o Qualifications and experience of key project team members, including subcontractors, who will be actively involved in the work o The quality of related work and knowledge exhibited in the submittal o References During negotiations, the selected Consultant must demonstrate that it has adequate and qualified staff and the necessary resources to perform the work. In no event shall there be any of the following unless Town's express prior written agreement is obtained: (1) any limitation on, or disclaimer of, implied or express warranties or the liability of Contractor; (2) any limitation of damages, including a limitation on consequential damages; (3) any requirement for arbitration or for mandatory mediation; (4) any requirement that Town officials or employees keep information confidential or any requirement that records by kept confidential by the Town, unless the requirement for confidentiality meets the requirements of the Public Records Law. Current, valid insurance policies meeting the above requirements shall be maintained for the duration of the project. Renewal certificates shall be sent to the Town of Chapel Hill thirty (30) days prior to any expiration date. There shall also be a 30 day notification to the Town in the event of cancellation or modification of any stipulated insurance coverage. Certificates of Insurance on an Acord 25 (8/84) or similar form meeting the required insurance provisions shall be forwarded to the Town of Chapel Hill. Wording on the Certificate of Insurance which states that no liability shall be imposed upon the company for failure to provide such notice is not acceptable. Original policies or certified copies of policies may be required by the Town at any time.
