Description

The Benton Public Utility Commission will receive sealed bids on a General Contract to relocate water and sewer utilities along Highway 5 from Military Road to Alcoa Road in Benton. The project consists of the installation of approximately 5,400 linear feet of proposed 12" water line, 1,700 linear feet of proposed 15" sewer line, 300 linear feet of proposed 10" sewer line, 250 linear feet of proposed 8" sewer line, and all associated manholes and appurtenances. The project also includes approximately 730 linear feet of proposed roadway bore and a creek crossing with water and sewer utilities. Buy America Requirements, as specified in Title 23 of the United States code Section 313 and Title 23 of the code of Federal Regulations Section 635.410, apply to this project. This requirement applies to all iron and steel products used on the project. Bids shall be on a unit price basis. All bids received in accordance with the terms of the advertisement shall be publicly opened and at a minimum, the total amount bid must be read aloud (the sponsor may choose to read the bids item by item). If any bid received is not read aloud, the name of the bidder and the reason for not reading the bid aloud shall be publicly announced at the letting. All interested parties are invited to attend. Pursuant to Ark. Code Ann. 22-9-203, the Owner encourages all small, minority, and women business enterprises to submit bids for capital improvements. Encouragement is also made to all general contractors that in the event they subcontract portions of their work, consideration is given to the identified groups. Bid must be submitted on the prescribed form and accompanied by a certified check or bid bond executed on the prescribed form, payable to Benton Public Utility Commission in an amount not less than 5 percent of the amount bid. The bid proposal and work of the proposed contract shall be in accordance with all applicable federal, state, county, and local laws, ordinances and regulations. For information concerning the proposed Work, contact Taylor White at the Engineers office. Benton Public Utility Commission hereby notifies all bidders that this contract is subject to applicable labor laws, non-discrimination provisions, wage rate laws and other federal laws including the Fair Labor Standards Act of 1938. The Work Hours Act of 1962 and Title VI of the Civil Rights Act of 1964 also apply. Registration and good standing in the System for Award Management (SAM) will be required prior to contract execution. In accordance with 23 CFR 635.110, any procedures and requirements for qualifying and licensing contractors must be approved by the Federal Highway Administration. Negotiation with contractors during the period following the opening of bids and before the award of the contract is strictly prohibited. Any Bid may be rejected which contains material omissions, or irregularities, or in which any of the unit prices are obviously unbalanced in the opinion of the Owner. Also, a bid may be rejected if it, in any manner, shall fail to conform to the conditions of the Bidding Requirements and Contract Documents. The Owner reserves the right to waive irregularities, reject bids, choose the most qualified bidder for the Project, and to postpone award of the Contract for a period of time which shall not exceed beyond 90 days from the bid opening date. The Work will be completed and ready for final payment in accordance with the General Conditions within 150 days after the date when the Contract Time commences to run
