Description

Subcontractor declarations must be submitted to the above-mentioned representative no later than 4:00 p.m. on the bid opening date stated above. The work under this Contract will include the construction of an approximately 0.75-acre public park. Work on the park will include site grading, constructing ADA compliant ramps, landings, and sidewalks, a design build irrigation system, construction of a stormwater swale, landscaping, construction of an asphalt parking lot, area lighting, and electrical supply. Work will also include the construction of a new park restroom at the Anchor Street Park including new water, sewer, and power service to the building. At the Wayside Park in the City Center, the existing brick restroom will be demolished by the contractor and a new park restroom will be constructed in it's place. The restroom design and materials for both the Wayside and Anchor Street restrooms was completed and supplied by Romtec through a preexisting contract with the City. The contractor will be responsible for constructing and installing the restrooms with the materials supplied by the City. Some fittings inside the building will still be the responsibility of the Contractor to supply and install. Please reference the Romtec scope of work for the division of work on this project. All work under this Contract must be substantially completed within 180 calendar days of the Notice to Proceed. Est. No bid will be considered unless fully completed in the manner provided in the Instructions to Bidders, and accompanied by a bid security executed in favor of the Owner in the amount not less than 10% of the total amount of the bid. Bid security is to be forfeited as fixed and liquidated damage should the bidder neglect or refuse to enter into a contract and provide suitable insurance certificates, bonds and other required documents for the faithful performance of the work in the event the bidder is awarded the contract. All bidders must be "equal opportunity employers" and comply with the appropriate provisions of state and federal law. In addition, all bidders are required to comply with ORS 656.017 regarding workers' compensation. Bidder, Contractor, and Subcontractors are required to be registered with Construction Contractors Board. Pursuant to ORS 279C.505(2), all Bidders must certify with their bids that they have an employee drugtesting program in place. If awarded a contract, Bidder must provide proof of such drug-testing program when executed Agreements are returned to Owner. Each Bidder must submit a subcontractor list to the Owner within two working hours of the time for receipt of bids in accordance with ORS 279C.370 (3) and OAR 137-049-0360. This contract is for public work and is subject to ORS 279C.800 to 279C.870. Prevailing wage rates for public works contracts in Oregon are required for this project. No bid will be received or considered by the Owner unless the bid contains: 1) a statement that bidder will comply with the provisions of ORS 279C.840; 2) a statement as to whether the bidder is a resident bidder as defined in ORS 279A.120. Before starting work, the contractor and every subcontractor employed under this contract is required to have a public works bond filed with the Construction Contractors Board, in accordance with ORS 279C.830 (3), unless the contractor or subcontractor is exempt under ORS 279C.836 (4), (7), (8), or (9). Upon award of this contract, the Owner is required to pay a fee to the BOLI Prevailing Wage Rate Unit in accordance with ORS 279C.830 (2) and OAR 839-025-0200. The amount of the fee shall be one tenth of one percent (.001) of the contract price; however, the fee must be no less than $250 or more than $7,500 regardless of the contract price. The Owner may reject any bid not in compliance with all prescribed public bidding procedures and requirements and may, for good cause, reject any and all bids upon a finding of the Owner that it is in the public interest to do so. No bidder may withdraw or modify a bid after the hour set for the receipt of bids, and thereafter until the lapse of 70 days after the bid opening. *The value for this project is based on a financial range. The value is listed as the highest possible cost from the range provided by a stakeholder or official project document.
