Description

All bids must be accompanied by a BID GUARANTY in the form of (1) a Certified Check, or Revocable Letter of Credit pursuant to Chapter 1305, ORC, in an amount not less than ten percent (10%) of the total amount of base bid plus all alternates; or (2) a Bid Bond drawn upon an acceptable Surety Company, for the full amount of the bid plus all alternates, one hundred percent (100%) of the bid, both forms of guaranty as provided in Chapter 153 of the Ohio Revised Code. The bid guaranty shall be made conditionally payable to the Board of Commissioners of the County of Jefferson, State of Ohio. The bid guaranty shall be made unconditionally payable to the Board of Commissioners of the County of Jefferson, State of Ohio. All bid guarantees shall be conditioned that if the bid is accepted within sixty (60) days of the bid opening, a proper contract shall be executed and that upon failure or refusal to enter into said Contract within ten (10) days after receipt of notification of award the bidder and surety on any bond shall be liable to the County in an amount not to exceed ten percent (10%) of the bid. The successful bidder, upon receipt of the Notice of acceptance of the bid, must furnish a Performance Bond in an amount of one hundred percent (100%) of the Contract amount, to the Board of Commissioners of the County of Jefferson, State of Ohio, said Bonds to be unconditionally payable to the Board of Commissioners. Said Bonds to be that of an approved Surety Company authorized to transact business in the State of Ohio, and shall be underwritten by a Surety that is listed on the most current Department of Treasury 570, Surety Companies Acceptable on Federal Bonds. Pursuant to Ohio Revised Code Section 9.24, it is now mandatory that prior to awarding of contracts for goods, services or construction for Jefferson County, a search must be made on the FINDING FOR RECOVERY DATABASE of the Auditor of the State of Ohio to determine if a prospective successful bidder has a finding against it for non-payment of an obligation to the State or political subdivision thereof. Upon rejection of any bid, the Bid Guaranty shall forthwith be returned to the unsuccessful bidder, upon the acceptance of a bid, the Bid Guaranty shall be returned to the successful bidder upon the proper execution and securing of the Contract. Contractors shall comply with all applicable federal, national and state codes and regulations listed in the Supplemental, General and Special Conditions. All Contractors doing business in Ohio must be licensed to perform work in the State; the Contractor's Ohio License Number must be affixed to all submitted construction bids and fully executed and binding construction contracts or agreements. Each individual employed by the Contractor or any Sub-Contractor and engaged in work on the project under this Contract shall be paid the Prevailing Wage established by the Department of Industrial Relations of the State of Ohio and Davis Bacon. This shall occur regardless of any contractual relationship which may be said to exist between the Contractor or any Sub-Contractor and such individual. Each bid submitted must have a copy of a current Equal Employment Opportunity (EEO) Certificate of Compliance as evidence that the contractor is certified by the State Equal Employment Opportunity Coordinator. Each bid must also comply with the Affirmative Action requirements as stated in the bid documents. Each bid must contain the full name of the party or parties submitting the bid and all persons interested therein. Each bidder must submit evidence of its experience on project of similar size and complexity. All Contractors and Sub-Contractors involved with the project will, to the extent practicable, use Ohio products, materials, services and labor in the implementation of the project. Additionally, Contractor compliance with Equal Employment Opportunity Requirements of the Ohio Administrative Code Chapter 123, the Governor's Executive Order of 1972 of Governor's Executive Order 84-9 shall be required. The Non-Collusion Affidavit of Prime Bidder must be completed and submitted with all bids. All bidders shall pay particular attention to the rules and regulations of the EQUAL OPPORTUNITY POLICY, and to the AFFIRMATIVE ACTION PLAN, throughout the term of the project. No bidder may withdraw his/her bid during a period of sixty (60) days after the date of the bid opening. If, in the opinion of the Board of Commissioners of the County of Jefferson, State of Ohio, the acceptance of the lowest and best bid is not in the best interest of all concerned, the Board of Commissioners of the County of Jefferson, State of Ohio, may accept another bid so opened. The Board of Commissioners of the County of Jefferson, State of Ohio, reserves the right to accept or reject any and all bids and to waive all informalities. The Board of Commissioners of the County of Jefferson, State of Ohio, may reject any or all of the bids on any basis and without disclosure of a reason. The failure to make such a disclosure shall not result in accrual of any right, claim, or cause of action by any unsuccessful bidder against the County of Jefferson.
