Description

Bids for furnishing necessary materials, equipment, superintendence and labor for the Orange County Water Control and Improvement District #1, Sanitary Sewer Lift Station, generally described as the restoration of the District's Lower Lift Station located south of the District's wastewater treatment plant on Ferndale Street. The scope of work includes, but is not limited to, the construction of an elevated steel platform, installation of a new stand-by generator on an elevated steel platform, rehabilitation of electrical controls and switch gear on the elevated steel platform, replacement of self-priming pumps with submersible pumps, con1442863version of existing underground dry pump vault into a wet well for the submersible pumps, and other appurtenances as necessary. The right is reserved by the Orange County Water Control and Improvements District #1, as its interest may require, to accept or reject any or all bids, and to waive any informality in the bids received. Owner and Engineer, in making copies of Bidding Documents available on the above terms, do so only for the purpose of obtaining Bids for the Work and do not confer a license or grant for any other purpose. Bid Security, only in the form of: 1) a certified or cashier's check drawn on a Texas bank and made payable to the Orange County Water Control and Improvements District #1; or 2) a bond executed by a surety company authorized to do business in Texas, in the amount of not less than five (5%) percent of the total bid, must accompany each bid at the time it is submitted. Bids must be submitted in duplicate. Bids may be held by the Orange County Water Control and Improvements District #1, Texas for a period not to exceed 60 days from the date of the bid opening for the purpose of reviewing the bids and investigating the bidder's qualifications prior to the contract award. Time for receiving bids is subject to change pending review and approval of the plans and specifications by the Texas Water Development Board. This contract is contingent upon release of funds from the Texas Water Development Board IB 2 of 3 (TWDB). Any contract(s) awarded under this Invitation for Bids is/are expected to be funded in part by a loan or loan with principal forgiveness from the TWDB and a grant from the United States Environmental Protection Agency, U.S. EPA. Neither the State of Texas, the U.S. EPA, not any of its departments, agencies, or employees, are or will be a party to this Invitation for Bids or any resulting contract. Per Texas Government Code Section 2252.002, in order for nonresident bidders to be awarded a governmental contract, the bidder must bid projects at an amount lower than the lowest Texas resident bidder. In addition, Nonresident bidders shall submit the Vendor Compliance with Reciprocity on Non-Resident Bidder form, TWDB-0459. Any contract(s) awarded under this Invitation for Bids is/are subject to the American Iron and Steel (AIS) requirements of federal law, including federal appropriation acts. Bidders on this work will be required to comply with the Department of Labor regulations at 41 CFR Part 60-4, relating to Construction Contractors--Affirmative Action Requirements, which include the President's Executive Order No. 11246, as amended by the Executive Order No. 11375 and Executive Order No. 13672, in the award and administration of contracts awarded under TWDB financial assistance agreements. Failure by the Contractor to carry out these requirements is a material breach, which may result in the termination of the awarded financial assistance. Attention is called to the fact that not less than, the federally determined prevailing (Davis-Bacon and Related Acts) wage rate, as contained in the contract documents, must be paid on this project. (a) All laborers and mechanics employed by contractors and subcontractors on projects funded directly by or assisted in whole or in part by and through the Clean Water State Revolving Fund or Drinking Water State Revolving Fund shall be paid wages at rates not less than those prevailing on projects of a character similar in the locality as determined by the Secretary of Labor in accordance with subchapter IV of chapter 31 of title 40, United States Code. (b) Pursuant to Reorganization Plan No. 14 and the Copeland Act, 40 U.S.C. 3145, the Department of Labor has issued regulations at 29 CFR parts 1, 3, and 5 to implement the Davis-Bacon and related Acts. Regulations in 29 CFR 5.5 instruct agencies concerning application of the standard Davis-Bacon contract clauses set forth in that section. All grants, cooperative agreements, and loans funded under the Clean Water State Revolving Fund and Drinking Water State Revolving Fund shall include the standard Davis-Bacon contract clauses found in 29 CFR 5.5(a), which shall also be incorporated in any resultant covered contracts that are in excess of $2,000 for construction, alteration or repair (including painting and decorating). Upon award, the successful bidder will be required to furnish payment and performance bonds.
