Description | The County of Burlington seeks bids for the provision of goods/services per the specifications. Pursuant to Section 2 of P.L. 1971, c.198 (C.40A:11-2), The successful bidder shall furnish and deliver a performance bond in the full amount (100%) of the total contract price within ten (10) days of the date of the contract award in accordance with N.J.S.A. 2A:44-147. The performance bond must be issued to The Board of County Commissioners of the County of Burlington by a surety company authorized to transact business in New Jersey. Deadline for inquiries or questions related to this bid shall be July 12, 2023, at 5:00 PM (local time). The second and third paragraphs of this subsection shell be changed deleted and replaced to: The bid shall be accompanied by a Bid Bond (Proposal Bond) or certified check or cashiers check for a sum of not less than 10% of the total contract price bid for the project, but not in excess of $20,000.00, made payable to the Treasurer of Burlington County . The Bid Bond (Proposal Bond) shall be properly filled out, signed, and witnessed and shall be furnished only by such Surety Company or Companies as are licensed and authorized to write Surety Bonds by the New Jersey Department of Insurance and in accordance with N.J.A.C.16:44- 7.3(e). The Contractor understands and agrees that all work must be performed in an orderly and closely coordinated sequence so that the date for substantial completion is met. If the Contractor fails to complete his work or fails to complete a portion of his work, he/she shall pay the County, as liquidated damages and not as a penalty, the sum as specified below. Such amount is agreed upon as a reasonable and proper measure which the County will sustain each calendar day by failure of the Contractor to complete the Work within the stipulated time. Substantial completion shall be determined by the County Engineer and shall be deemed completion of the whole work for purposes of tolling the Mechanic Lien Law. It is further understood by the Contractor that the County will suffer financial loss if the Project is not substantially complete on the date set forth in the Contract Documents. For damages occurring at the time of delay, the County may retain the amount due to him under this section from any payment due to the Contractor.
