RFQ Engineering - Critical Repairs and Upgrades to Its Wastewater and Sewer System

The City encourages minorities, small business, and women owned business to submit their qualifications. The City will be utilizing federal funding of the American Rescue Plan and the engineer should be familiar with said requirements. The bidders must comply with Title VI Federal Compliance. All applicants shall also comply with the requirements of the Equal Employment Opportunity Commission and must meet the definition of an equal employment opportunity workforce. The City is committed to developing, establishing, maintaining, and enhancing Disadvantaged Business Enterprise (DBE) involvement in the procurement process. The City, its contractors, their suppliers and sub-contractors, vendors of goods, equipment, services, and professional services, shall not discriminate on the basis of race, color, religion, national origin, age, handicap, or sex in the award and/or performance of contracts. However, competition of work remains the ultimate standard in contractor, sub-contractor, vendor service, professional service, and supplier utilization. No employee, officer, or agent may participate in the selection, award, or administration of a contract supported by a Federal Award if he or she has a real or apparent conflict of interest. All contracts and subgrants shall contain a provision that requires the award to comply with all appliable standards, orders or regulations issued pursuant to the Clean Air Act (42 U.S.C. 7401-7691 et seq.) and the Federal Water Pollution Control Act. The engineer shall at all times observe and comply with Federal and State of Arkansas laws, local laws, ordinances, orders, and regulations existing at the time of, or enacted subsequent to the execution of a resulting contract, which in any manner affect the completion of the work. The engineer shall indemnify and save harmless the agency and all its officers, representatives, agents, and employees against any claim or liability arising from or based upon the violation of any such law, ordinance, regulation, order or decree by an employee, representative, or subcontractor of the engineer. Fee information will not be considered in the selection process and must not be submitted with the statement of qualifications. Fees will be negotiated for the project after an engineer has been selected. The method of contractor selection has not been determined at this time.
