Description

Prospective Bidders shall provide a Pre-Bid Submittal at the Pre-Bid Conference containing the following information: 1. Evidence of similar previous projects of at least $20 million value completed in the previous 10 years, including detailed descrip- tion, bid amount, final contract amount, scheduled time of com- pletion, actual time of completion, Owner's contact information, and Engineer's contact information. 2. Description of any lawsuits or claims the Bidder has been party to in the previous 10 years including resolution. 3. Number of employees directly employed by the Bidder. 4. Resumes or description of the proposed Project Manager and Project Superintendent including name, relevant experience, and em- ployment history with the Bidder. The work is in one Contract and in- cludes the following general items of work: CONTRACT 19-01 WASTEWATER TREATMENT PLANT IMPROVEMENTS New Influent Pumping Station New Headworks including mechani- cally cleaned step screen, grit remov- al, and influent flow meter New Sequencing Batch Reactor Basins New Effluent Pump Station New Operations and Maintenance Building New Sludge Storage Facility New Blower/Electrical/Chemical Feed Building New Decant Flow Meter and Chem- ical Feed Pit Site piping Demolition of the existing Head- works, existing Drying Beds, existing Chlorine and Blower Building, existing Effluent Pumping Station and Chlori- nator Building, and existing Third Ave- nue Sewage Pumping Station Renovation of existing aeration ba- sins to Chlorine Contact Chamber and Sludge Holding Basins Renovation of existing aerobic di- gestors to Sludge Holding Basins Electrical work HVAC work New SCADA System as described in the Detailed Specifica- tions and shown on the Plans. The allotted time for construction for this contract is 720 calendar days. Liq- uidated damages are one thousand dol- lars ($1,000.00) per calendar day. FEDERAL AND STATE FUNDS This project will be partially funded with Federal and State funds from the U. S. Department of Commerce Economic Development Administration, EDA In- vestment No 04-79-07377, and Ten- nessee State Revolving Fund Loan Pro- gram, SRF Loan Nos. CW8 2021-453 and SRF 2021-454; therefore, is subject to the Federal laws and regulations as- sociated with these programs. DAVIS-BACON ACT and AMERICAN IRON AND STEEL REQUIREMENTS This project is funded by a grant from the U.S. Department of Commerce Economic Development Administration (EDA) and by a State Revolving Fund loan on or after 2014 EPA Fiscal Year. The loan recipient must be in compli- ance with all applicable Davis-Bacon Act and American Iron and Steel re- quirements. DISADVANTAGED BUSINESS EN- TERPRISES (DBE) REQUIREMENTS Any contract or contracts awarded by the Owner through this invitation for bids will be funded by a State Revolving Fund (SRF) loan from the State of Ten- nessee. State and Federal funds will be involved in this project, and, as a result, Bidders must comply with the SRF Loan Program's Disadvantaged Business En- terprises (DBE) requirements including contacting a minimum of 10 qualified DBE sub-contractors, professional ser- vice providers, vendors, and/or suppli- ers by certified mail to solicit bids. The apparent successful Bidder must submit to the Owner copies of the certified letters and return receipts prior to contract award. Neither the State of Tennessee nor any of its de- partments, agencies, or employees is or will be a party to this Invitation for Bids or any resulting contract(s) awarded by the Owner. EACH BIDDER MAY SUB- MIT DOCUMENTATION OF HIS/HER SOLICITATION WITH HIS/HER BID IN ORDER TO ASSIST THE OWNER IN PROMPT AWARD OF THE CONTACT. Each bidder must deposit with his bid, security in the amount, form and subject to the conditions provided in the Instruc- tions for Bidders. All bidders shall comply with all pro- visions of TCA 50-9-113 as it relates to Drug-Free Workplace requirements. The Contractor shall complete the DrugFree Workplace Affidavit of the Prime Bidder form and submit it with his/her bid. The Contractor shall be responsible for any of its Subcontractor(s) compliance with said law. All bidders shall comply with all provisions of Chapter 878 of TCA 12-4-1 as it relates to certification of compliance regarding illegal immigrants. The Contractor shall complete the Statement of Compliance Certificate Illegal Immigrants and submit it with her/her bid. The Contractor shall be responsible for any of its Subcontractor's compliance with said law. All bidders shall comply with all provisions of Chapter 817 of TCA 12-12-106 as it relates to certification of compliance regarding the Iran Divestment Act. The Contractor shall complete the Statement of Compliance Certificate Iran Divestment Act and submit it with her/her bid. The Contractor shall be responsible for any of its Subcontractor's compliance with said law. In compliance with TCA 12-4-126(a) and (b) the ENGINEER will not issue addenda less than forty-eight (48) hours before the bid opening date and time; further, any questions concerning the bid documents shall be received by the ENGINEER before ninety-six (96) hours prior to the bid opening date and time. The successful bidder is required to furnish both an acceptable performance bond and payment bond each in the amount of one hundred percent (100%) of the contract price. All bidders must be licensed general contractors as required by the Contractors Licensing Act of 1976 of the General Assembly of the State of Tennessee and qualified for the type of construction being bid upon. EACH BIDDER SHALL WRITE ON THE OUTSIDE OF THE ENVELOPE CONTAINING THE BID THE CONTRACTOR'S LICENSE NUMBER, THE EXPIRATION DATE, AND THAT PART OF THE CLASSIFICATION APPLYING TO THIS BID. If this is not done, the bid will not be opened. Each bidder shall be properly licensed and abide by the provisions of TCA 62-6-119 including part (b) which states in part: "(b) The person or entity involved in the preparation of the invitation to bid or comparable bid documents, includ- ing any electronic bid documents, shall direct that the following information be written upon the bid envelope or provid- ed within the electronic bid document: (1) The name, license number, expiration date thereof, and license classification of the contractor applying to bid for the prime contract; (2) The name, license number, expiration date thereof, and license classification of the contractor applying to bid for the masonry contract where the total cost of the materials and labor for the masonry portion of the con- struction project exceeds one hundred thousand dollars ($100,000); (3) The name, license number, expiration date thereof, and license classification of the contractor applying to bid for the elec- trical, plumbing, heating, ventilation, or air conditioning contracts except when such contractors portion of the con- struction project is less than twenty-five thousand dollars ($25,000); (4) For each vertical closed loop geothermal heating and cooling project, the company name, Tennessee Department of Environment and Conservation license number, classification (G, L or G,L) and the expiration date, except when the geothermal portion of the construction project is in an amount less than twenty-five thousand dollars ($25,000); (5) Prime contractor bidders who are to perform the masonry portion of the construction project which exceeds one hundred thousand dollars ($100,000), materials and labor, the electrical, plumbing, heating, ventilation or air conditioning or the geothermal heating and cooling must be so designated; and (6) Only one (1) contractor in each of the classifications listed above shall be written on the bid envelope or provided within the electronic bid doc- ument. The Owner reserves the right to reject any and all bids, to waive informalities, and to negotiate with the apparent quali- fied best bidder or bidders to such extent as may be necessary. No bidder may withdraw his bid for 90 days, while the Owner considers the bids. Mutually agreed upon time extensions may be made if necessary.
