Description

No bids will be received after the hour named. The City of Newark, hereinafter called the "Owner" accepts no responsibility for any submittal of bids before their presentation at the date and hour indicated for the formal bid opening. The work includes the in-place rehabilitation with cured-in-place pipe of approximately 13,875 linear feet of small diameter (less than 23-inch diameter) combined sanitary/storm sewer; replacement of approximately 262 linear feet of small diameter combined sanitary/storm sewers located throughout the City of Newark. Work not detailed here but also included in the project are, point repairs of existing sewers, manhole replacement, and manhole rehabilitation and the repair and relocation of water mains as needed. Contract Documents may be examined and obtained at the Department of Water & Sewer Utilities, Division of Sewers and Water Supply, 1294 McBride Avenue, Little Falls, New Jersey during regular business hours. Bidders will be furnished with one set of Contract Documents for the fee specified. Additional sets may be purchased for the deposit specified. No refunds will be given for the return of additional sets. Each Bid shall be submitted in accordance with the Instructions to Bidders and shall be accompanied by a Bid Security in the amount of ten (10) percent of the Bid, but not in excess of $20,000.00. No Bidder may withdraw his/her Bid for a period of sixty (60) calendar days after the actual date of the opening of the Bids, except for reasons covered under N.J.S.A. 40A:11-23.3. The Successful Bidder must furnish a 100 percent Performance Bond, a 100 percent Payment Bond and an Environmental Maintenance Bond with a surety company licensed in the State of New Jersey, and meets the requirements of N.J.S.A. 2A:44-143. Surety company shall also be listed on the latest version of the U.S. Department of Treasury Circular 570. After the award of the Contract, and prior to the start of the work, the Successful Bidder shall be required to attend a preconstruction meeting, to be scheduled by the Owner. The preconstruction meeting shall include representatives from the Owner, Engineer, Successful Bidder, any environmental and construction inspectors and the New Jersey Department of Environmental Protection. The Contractor's plan to meet SED Utilization Requirements shall be submitted by the successful bidder within 30 days of contract award. The Contractor's Plan will include statements of how the SED participation requirement shall be achieved over the duration of the project. Complete instructions for filing Bids are included in the Instructions to Bidders. All bidders must comply with N.J.S.A. 40A:11-1, as amended relative to the submission of a certification of the bidder, indicating the ability to perform the Contract. The bidder, in conformance with N.J.S.A. 52:25-24.2, shall submit with its Bid, a statement setting forth the names and addresses of all stockholders who own a ten percent (10%) or greater interest in the firm. The successful bidder shall be required to comply with the provisions of the New Jersey Prevailing Wage Act, N.J.S.A. 34:11-56.25 et seq. The successful bidder shall be required to comply with Davis-Bacon prevailing wage requirements (40 U.S.C. 3141 et seq. and 29 CFR Parts 5,6), and the higher of the state or federal wages shall apply. This Bid is subject to New Jersey Local Public Contracts Law N.J.S.A. 40A:11-1 et. seq. Bidders must comply with P.L. 2003, Chapter 91 (Public Works Contractor Registration). Bidders must be registered with the New Jersey Department of the Treasury and shall comply with N.J.S.A. 52:32.44 by providing a Business Registration Certificate prior to contract award. All Bids are subject to the requirements of all laws and City of Newark Ordinances affecting it. The bidder's attention is directed to Sec. 2:4-14 of the City of Newark Administrative Code. Bidders are also advised as to the applicability of the City of Newark's Affirmative Action Program. Bidders are required to comply with the requirements of N.J.S.A 10:5-31 et. seq. and N.J.A.C. 17:27. In addition, the Contractor must certify that at least 25% of the total Contract bid price will be directed and paid to a minority business enterprise, either through joint venture arrangement, partnerships, subcontractors, the purchase of goods and services, or any other method available. The term "minority business enterprise" means a business at least fifty-one (51) percent of the stock of which is owned by a minority group member. "Minority group members" are citizens of the United States, who are Black, Hispanic, Asian American, Indians, Eskimos, and Aleuts. Successful bidders shall be required to attend a meeting with and obtain clearance from the City of Newark's Office of Affirmative Action before the execution of the Contract. An additional seven percent (7%) of the total Contract bid price will be directed and paid to a women's business enterprise, either through joint venture arrangements, partnerships, subcontractors, the purchase of goods and services, or any other method available. The term "women's business enterprise" means a business where at least fifty-one (51) percent of the stock is owned by women. The Owner is seeking funding for this project through the New Jersey Environmental Infrastructure Trust and the New Jersey Department of Environmental Protection. The successful bidder must comply with all the provisions of N.J.A.C. 7:22-9 et. seq. for the participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SEDs). The successful bidder must comply with the Project Plan provided in Section 00810 for fulfilling SED utilization requirements. This contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Infrastructure Trust. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies, or employees is, or will be a party to this Contract or any lower-tier contract or subcontract. This Contract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9, and 10. In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a)24 and 4.17(a)24, the contractor (subcontractor) shall comply with all of the provisions of N.J.A.C. 7:22-9. The Owner reserves the right to reject all Bids in accordance with N.J.S.A. 40A:11-13.2 and waive minor informalities. The Contract will be awarded to the lowest responsible and responsive bidder, in accordance with applicable law.
