Description | Bidders' proposals must be accompanied be a certified check, or bid bond, payable to the Town of Goshen, equal to five (5) percent of the amount bid, conditional that if the bidder's proposal is accepted, he will enter into contract for such work and that he will furnish a performance bond in a sum equal to the total amount of the bid guaranteeing the satisfactory completion of the Contract; and that he will furnish a labor and materials payment bond guaranteeing payment for all labor and materials. If the bidder whose proposal is accepted shall fail to comply with the above requirements within ten (10) days after the proposal shall have been accepted, then the check or bid bond deposited as aforesaid shall be forfeited as liquidated damages. All proposals shall be made on the form provided in the specifications. Proposals shall be sealed and marked on the outside of the envelope "Improvements to Town Hall - Roof Restoration and Window Replacement" and shall be addressed to the Town Clerk, Town of Goshen, 41 Webster Street, Goshen, New York 10924. Proposals will be publicly opened and read at the aforesaid time and date unless bidders are notified otherwise. To the greatest extent allowed by law, the Town Board reserves the right to waive any informalities in the bids or proposals, and to select the bid or proposal, the acceptance of which in its judgment will best serve the efficient performance and guaranteed completion of the work or to reject any and all bids presented, or to award the contract to other than the low bidder if, in the opinion of the Board, the best interest of the Town may be served thereby, or to accept the whole or any part of a bid or proposal as the same may be modified by mutual consent, or to re-advertise the proposed work for new bids within the sole discretion of the said Town Board. Attention of bidders is called to the requirements as to conditions of employment to be observed and minimum wage rates to be paid under the contract. Workmen's Compensation and Public Liability Insurance shall be carried by the contractor at his own expense. Bidders are further advised that they must submit non-collusion affidavits together with their bids, in accordance with the requirements of New York State Law. Bidders are advised that they should not include in their bid sales and compensating use taxes on the cost of materials which are to be incorporated into the work and which are to be separately sold by the Contractor to the municipality prior to incorporation into the work. |
