Description

For Raleigh County Schools HVAC Renovations Provide one original Bid to the attention of: Phillip Jarrell, Director of Purchasing Raleigh County Schools, Auxiliary Services 2001 South Kanawha Street, Beckley, WV 25801 All Bids must be submitted in accordance with the Specifications and Construction Drawings prepared by: ZDS DESIGN ONSULTING SERVICES 135 Corporate Center Drive, Suite 532, Scott Depot, WV 25560 Telephone (304) 755-0075, Fax (304) 755-0076 Bids must be submitted using the three (3) envelope system. Envelope #3 shall be opaque, addressed to the party receiving the Bids, and will include name of Project, Bidders name and address, date and time of the Bid submission, and designated portion of the Work (ie: HVAC) for which the Bid is being submitted on the outside of the envelope. Facsimile or electronically submitted Bids will not be accepted. Envelopes #s 1 and 2 shall be inserted in Envelope #3 and sealed. Envelope #1 A valid Bid Bond (equal to 5% of the Base Bid) A valid WV Contractor License List of Subcontractors and Suppliers - completed and signed State of WV Purchasing Affidavit -completed and signed State of WV Drug Free Work Place Affidavit -completed and signed Certificate of Receipt of Addenda - completed and signed Envelope #2 Form of Proposal - completed and signed Bidders will provide a convenience copy to ZDS Design onsulting Services, via e-mail to contact@zdsdesign.com after the Bid opening. Electronic Copies of the Bidding Documents will be available from the office of the Engineer, ZDS Design onsulting Services, 135 Corporate Center Drive, Suite 532, Scott Depot, WV 25560, telephone 304-755-0075 All Bidding Document requests for information, substitution requests and correspondence shall be submitted in writing and directed to the Engineers administrative email at: contact@ zdsdesign.com. Addenda will be issued by the Engineer to registered bidding document holders only, who will automatically receive all addenda in electronic format (PDF) via file transfer email. Additional reproduced paper copies of the initially issued Bidding Documents and any subsequent addenda are also available from the Engineer upon request by registered bidding document holders only, and upon payment of a non-refundable cost; contact the Engineer for further information. Bidding Documents include both Specifications and Drawings and both must be purchased at the same time. All Prime Contractors and Subcontractors shall be licensed in compliance with West Virginia Code Chapter 21, Article 11 (Contractor Licensing Act) and the West Virginia Code 21-1D-5 requiring a Drug Free Workplace. All Prime Bidders and sub-contractors are required to utilize local labor pursuant to Chapter 21-Article 1C, the West Virginia Jobs Act. Pursuant to Chapter 21-Article 11 of the West Virginia Contractor Licensing Act of 1991. All Contractors doing business in West Virginia must be licensed to perform work in the State; the Contractors WV License number must be affixed to all submitted construction bids and fully executed and binding construction contracts or agreements. Any and all construction must be in conformance with all applicable state and federal regulations. The successful Bidder will be required to execute a contract, comply with all rules and regulations of the West Virginia Workers Compensation Laws, and provide evidence of insurance coverage to the minimum limits required by the contract documents. All Prime contractors shall include their West Virginia Contractor License Number in their Bid Proposal. All Prime contractors bidding the project are encouraged to attend the sites to familiarize themselves with the project locations, site conditions and other relevant information. The work of the HVAC projects is partially funded by Federal Grant and as such is subject to compliance with the following Federal requirements as set forth in the Bidding Documents: 1) Davis-Bacon Act. (40 U.S.C. 3141 3144, and 3146 3148); 2) The Equal opportunity clause provided under 41 CFR 60 1.4(b), contractors will not discriminate against any employee or applicant for employment because of race, color, religion, sex, sexual orientation, gender identity, or national origin. The contractor will take affirmative action to ensure that applicants are employed, and that employees are treated during employment without regard to their race, color, religion, sex, sexual orientation, gender identity, or national origin; 3) The Contract Work Hours and Safety Standards Act (40 U.S.C. 3701 3708); the Clean Air Act (42 U.S.C. 7401 7671Q); the Federal Water Pollution Control Act (33 U.S.C. 1251 1387); Byrd Anti Lobbying Amendment (31 U.S.C. 1352); and section 6002 of the Solid Waste Disposal Act; and 4) As appropriate and consistent with law and to the greatest extent possible the Domestic Preferences for Procurements (2 Cfr 200.323) and Small and Minority Businesses, Womens Business Enterprises, and Labor Surplus Area Firms (2 Cfr 200.321) are preferred; 5) Contract award (see 2 CFR 180.220) will not be made to parties listed on the government wide exclusions in the System for Award Management (SAM). All Bidders must comply with Title VI of the Civil Rights Act of 1964, the Copeland Act, the Contract Work Hours and Safety Act, the Americans with Disabilities Act. Any and all construction must be in conformance with all applicable state and federal regulations. Partial funding for the HVAC of the Project has been made available through the Elementary and Secondary School Emergency Relief Fund (ESSER Fund). ESSER is governed by the General Education Provisions Act which requires all contractors to meet all Davis-Bacon prevailing wage requirements and pay wages that are not less than those established for the locality of the project (prevailing wage rates). All Contractors and Subcontractors shall be subject to Davis-Bacon wages, rules, and regulations. The Contractors shall provide Builders Risk Insurance for the total value of the Bid. All bids must be accompanied by a Bid Bond, executed by the Bidder and an acceptable Surety in the amount equal to five percent (5%) of the Bid and in favor of the Owner, the Raleigh County Board of Education. No accepted Bid(s) shall be waived or returned because the Bidder(s) failed to, or cannot comply with, the requirements as set forth in Bidding Documents. The bidder to whom the contract is awarded shall execute and deliver to the Owner after the award, and before signing the contract, a corporate payment and performance bond in a penal sum equal to at least the contract sum and the cost of such a bond shall be paid by the Bidder. The Owner reserves the right to reject any or all bids, and the right to withhold final award of contract for sixty (60) days after opening bids. The goal is to issue a Letter of Intent for Notice to Proceed within 45 days after bid opening. This Contract will be subject to liquidated damages in the amount of one-thousand dollars ($1,000.00) per day for failure to achieve substantial completion indicated in contract documents.
