Description

Responses that exceed $50,000.00 must be accompanied by a surety bond of a surety company duly authorized to do business in the State of Minnesota; in an amount equal to five percent (5%) of the total amount of the response, which is submitted as a solicitation security conditioned upon the Responder entering into a contract with the State of Minnesota in accordance with the terms of the solicitation. Responders must upload a copy of their surety bond as prompted in the Event. The State reserves the right to require the Contractor provide the original surety bond to the State. If such request is made, the Contractor must submit the original surety bond within seven (7) calendar days upon such request. If the original surety bond is not received within (7) calendar days of request, the State may take action including rejection of the response or cancellation of the contract for cause. If the solicitation security is in the form of a certified check, cashier's check, or money order made payable to the State of Minnesota, it must be received by the Contracting Agency at the address identified within this Event in a clearly marked and sealed envelope no later than the due date and time indicated in the Event. Late submissions will result in rejection of your response. Facsimile or copies of a certified check, cashier's check, or money order will not be accepted. The solicitation security submitted is conditioned upon the responder's entering into a contract with the State of Minnesota in accordance with the terms of the solicitation. It is agreed that said solicitation security of the successful responder will constitute liquidated damages, not a penalty, for the failure or refusal of the successful responder to execute and deliver the contractual documents, in a correct form, within ten (10) calendar days after receipt of the contract documents. The solicitation security submitted is conditioned upon the responder's entering into a contract with the State of Minnesota in accordance with the terms of the solicitation. It is agreed that said solicitation security of the successful responder will constitute liquidated damages, not a penalty, for the failure or refusal of the successful responder to execute and deliver the contractual documents, in a correct form, within ten (10) calendar days after receipt of the contract documents. Pursuant to Minnesota Statutes 177.41 to 177.44 and corresponding Minnesota Rules 5200.1000 to 5200.1120, this contract is subject to the prevailing wages as established by the Minnesota Department of Labor and Industry. Specifically, all contractors and subcontractors must pay all laborers and mechanics the established prevailing wages for work performed under the contract. Failure to comply with the aforementioned may result in civil or criminal penalties. Prevailing Wage requirements apply to a contract or work under a contract, under which: 1. only one trade or occupation is required to complete it and the project is greater than $2,500; or 2. the estimated total cost of completing the project is greater than $25,000. The Contractor and Subcontractor shall furnish to the Contracting Authority and the Project Owner all payrolls, of all workers on the project, via E-mail as attachments, to the appropriate E-mail address: prevailingwage.dnr@state.mn.us
