The basis for award will be based solely on the Road and Sewer projects with the Water being an additional option which will need to approved by NSID. The following is applicable to Federal-aid projects. The County of Spokane, in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252,42 U.S.C. 2000d to 2000d-4) and the Regulations, hereby notifies all bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full and fair opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award. BID DEPOSIT REQUIRED. No bid may be considered for public work unless it is accompanied by a bid deposit in the form of a surety bond, postal money order, case, cashier check or certified check in an amount equal to five percent (5%) of the amount of the bid proposed. If the bidder to whom the contract is awarded fails to enter into the contract and furnish the contractor bond as required within ten delays after notice of the award, exclusive of the day of notice, the amount of the bid deposit shall be forfeited to the County and the contract awarded to the next lowest and best bidder. If the bid deposit is """cash""" and is in the form of a postal money order, cashier""'s check or certified check the checks are to be made payable to the Spokane County Treasurer. Cash bid deposits are to accompanied by a completed Bid Deposit Form (see Appendix). If the bid deposit is in the form of a surety bond it must be of a corporate surety licensed to do business in the State of Washington accompanied by a completed Bid Deposit Surety Bond Form (see Appendix). WARNING: If the bidder is to submit a bid deposit in the form of a Surety Bond, the County strongly recommends the use of the County Bid Deposit Surety Form contained in the appendix. Recent analysis has revealed that as many as 30% of the bid surety bonds submitted on public works projects are potentially fatally flawed as the contain qualifications to the 5% forfeiture penalty mandated by RCW 36.32.250. If the County Bid Deposit Surety Bond Form is not used, the bidder is warned to take special care in assuring that the language contained in the form used does not materially alter, qualify or conflict with the terms and conditions set forth in the County Bid Deposit Surety Bond Form, Bid Deposit Surety Form and RCW 36.32.250. Any such material alteration, qualification or conflict shall make the bid non-responsive and shall cause the bid to be rejected by the County. Bidders, The successful bidder will be required to file a performance bond in the full amount of the contract price which bond shall be furnished by a Surety Company acceptable to the Board of County Commissioners. The Board of County Commissioners reserves the right to reject any or all bids or any part of a single bid and to waive all informalities in the bidding |
