Description

DEPARTMENT OF WATER AND SEWER UTILITIES OF THE CITY OF NEWARK The City of Newark hereinafter called the "Owner" accepts no responsibility for any submittal of bids prior to their presentation at the date and hour indicated for the formal bid opening. The work includes the asphalt pavement repair, curb-to-curb milling and resurfacing and miscellaneous restoration of up to 250,000 SY of street pavement located at various locations throughout the City of Newark, where lead service line replacement and water and sewer repairs have been previously performed. At the time Contract Documents are purchased, Contractors shall also be required to furnish a valid fax number to which all addenda can be directed. Bidders will be furnished one set of Contract Documents for the deposit specified. Additional sets may be purchased for the deposit specified. No refunds will be given for the return of any bidding documents. Each Bid shall be submitted in accordance with the Instructions to Bidders and be accompanied by a Bid Security in the form of a bid bond from a surety company licensed to do business in the State of New Jersey or a certified check in the amount of ten (10) percent of the Bid amount, not to exceed twenty thousand dollars. Bid Security must be accompanied by a consent of surety from the surety company. No Bidder may withdraw his/her Bid for a period of sixty (60) calendar days after the actual date of the opening of the Bids, except for reasons covered under N.J.S.A. 40A:11-23.3. The Successful Bidder must furnish a 100 percent Performance Bond, and a 100 percent Payment Bond with a surety company licensed in the State of New Jersey, and meets the requirements of N.J.S.A. 2A:44-143. Surety Company shall also be listed on latest version of the U.S. Department of Treasury Circular 570. Complete instructions for filing Bids are included in the Instructions to Bidders. All bidders must comply with N.J.S.A. 40A:11-1, as amended relative to submission of a certification of the bidder, indicating the ability to perform the Contract. The bidder, in conformance with N.J.S.A. 52:25-24.2, shall submit with its bid, a statement setting forth the names and addresses of all stockholders who own a ten percent (10%) or greater interest in the firm. The successful bidder shall be required to comply with the provisions of the New Jersey Prevailing Wage Act, N.J.S.A. 34:11-56.25 et seq. The successful bidder shall be required to comply with Davis-Bacon prevailing wage requirements (40 U.S.C. 3141 et seq. and 29 CFR Parts 5, 6), and the higher of the state or federal wages shall apply. The Bid is subject to New Jersey Local Public Contracts Law N.J.S.A. 40A:11-1 et. seq. Bidders must comply with N.J.S.A. 52:32.44 by providing a Business Registration Certificate prior to contract award. Pursuant to P.L. 2005, c.271, the "Pay to Play Legislation", a Contractor shall file an annual disclosure statement on political contributions with the New Jersey Election Law Enforcement Commission pursuant to N.J.S.A. 19:44A-20.13 (P.L. 2005, c. 271, s. 3) if the contractor receives contracts in excess of $50,000.00 from public entities in a calendar year. The contractor shall be responsible for determining if filing is necessary. Additional information on this requirement is available from ELEC at 888-313-3532 or at www.elec.state.nj.us All proposals are subject to the requirements to all laws and City of Newark Ordinances affecting same. The bidder's attention is directed to Sec. 2:4-14 of the City of Newark Administrative Code. Bidders are also advised as to the applicability of the City of Newark's Affirmative Action Program and must, during the performance of the Contract, comply with the requirements of N.J.S.A. 10:5-31 et seq. and NJAC 17:27. In addition, the Contractor must certify that at least 25% of the total Contract bid price will be directed and paid to a minority business enterprise, either through joint venture arrangement, partnerships, subcontractors, the purchase of goods and services or any other method available. The term minority business enterprise means a business at least fifty one (51) percent of the stock of which is owned by a minority group member. Minority group members are citizens of the United States, who are Black, Spanish speaking, Orientals, Indians, Eskimos, and Aleuts. Successful bidders shall be required to attend a meeting with, and obtain clearance from, the City of Newarks Office of Affirmative Action prior to execution of the contract. An additional seven percent (7%) of the total Contract bid price will be directed and paid to a womens business enterprise, either through joint venture arrangements, partnerships, subcontractors, the purchase of goods and services or any other method available. The term womens business enterprise means a business where at least fifty-one (51) percent of the stock is owned by women. The Owner reserves the right to reject all Bids in accordance with N.J.S.A. 40A:11-13.2 and waive minor informalities. The Contract will be awarded to the lowest responsible and responsive bidder, in accordance with applicable law.
