Description

All Bids are subject to the provisions of M.G.L. Ch. 30, Section 30B. This Contract is subject to Prevailing Wage Rates. Bids are to be accompanied by a Bid Security or Bid Deposit in the amount of five (5%) percent of the total amount bid. Bidders may not withdraw their Bids for a period of thirty (30) calendar days after the date of the Bid Opening. The successful Bidder will be required to furnish a Labor and Materials Payment Bond in the amount of 100% of the Contract Value to insure faithful performance of the Contract. Complete instructions for filing Bids are included in the Instruction to Bidders documents. LCWD reserves the right to waive any informality, to amend any specification, to accept any portion of a Bid or reject any or all Bids if deemed to be in the District's best interest. An award will not be made to a Contractor who LCWD deems insufficiently financed, experienced, equipped or staffed to undertake and complete the work. The LCWD reserves the right to authorize other Town of Lynnfield Departments (i.e. Department of Public Works) to purchase services under this Contract. The Award of this Contract and any subsequent extension is subject to annual fiscal year appropriation. The contract term shall extend from November 1, 2022 through November 1, 2023 with the option, at LCWD's sole discretion, to extend the term of the Contract for two (2) additional one (1) year terms. A termination due to non-appropriation, withdraw of funding or funding being exhausted shall be effective as of the date when such appropriated or authorized funds are exhausted or withdrawn without liability to the City for damages, penalties or other charges on account of such termination.
