As of March 8 the project has not yet been awarded. A timeline for award has not yet been established . Bids will be received for a single Contract. Bids shall be submitted on the form provided with the Project Manual. Because both federal and state funds are being utilized for this project, the Con-tractor shall pay the higher wages of either the Montana Prevailing Wage Rates or the Davis Bacon Wage Rates, based upon each's classification rules. This project requires the Contractor to comply with 1% Gross Receipts Tax per Montana Code An-notated. A Bid Bond in the amount of 10% of the contract amount is required with submission of Bid . And 100 % Performance and Payment Bonds are required from the Contractor prior to work commencing on site. Bidders are advised that the TRIBAL EMPLOYMENT RIGHTS AND REGULATIONS OF THE CROW TRIBE apply to the submitted bids to the extent required by law. Reference the Project Specifications for a full copy of the Tribal Employment Rights and Regulations of the Crow Tribe. Pursuant to the Crow Tribal Employment Rights Office (TERO) Bidders shall submit for approval a Compliance Plan and Bidders are advised that all Bid Proposal MUST contain a TERO Project Contracting Fee of One and half percent ( 1 . 5 % ) payable by the Bidder to the Crow Tribe. Reference the Project Specifications for the Crow Tribal Employment Rights Office (TERO) Compliance Plan. Bidders shall be responsible to comply with and pay all required fees for TERO Work permits for conducting business on the Crow Reservation. Reference the Project Specifications for TERO Work Permit Requirements Pursuant to the Tribal Employment Rights Regulations of the Crow Tribe, Part3 , ( a ) Competitive Awards... "Provided that, if a bid is submitted by a firm owned by a member of the Crow Tribe with-in 2% of the low bid that includes a copy of its certification from TERO, award shall be made to that firm if it is technically qualified to perform the work at reasonable price , as defined in Section 3.5 of this part." Pursuant to the Tribal Employment Rights Regulations of the Crow Tribe, Indian Preference in Employment and Training and Indian Preference in Contracting and Subcontracting shall be strictly enforced. No Bidder may withdraw their Bid until sixty (60) days after receipt of Bids. The Owner reserves the right to waive all informalities or reject any or all Bids.
