Description | ADA curb ramp replacement program along several roadways within the Township. In general, the work consists of, but is not limited to: ADA curb ramp construction, curb replacement, and pavement restorations. For the 2022 Middletown Township CDBG Curb Ramp Replacement Program Clarification Deadline: 7/7/2022 5:00 PM A certified check or bank draft, payable to the order of the Township of Middletown, negotiable U.S. Government Bonds (at par value), or a satisfactory Bid Bond executed by the Bidder and an acceptable surety, in an amount equal to ten (10%) of the total bid amount shall be submitted with each Bid. The successful Bidder will be required to furnish and pay for Satisfactory Performance and Payment Bond and Labor and Materialmen Bond, each in the amount of 100% of the awarded contract value. Upon completion of the contract, the Successful Bidder shall provide a 2-year Maintenance Bond in the amount of 100% of the final contract value. This Contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, which provides that training, employment and other economic opportunities generated by HUD assistance or HUD-assisted projects covered by section 3, shall, to the greatest extent feasible, be directed to low- and very low-income persons, particularly persons who are recipients of HUD assistance for housing. The bidder is specifically advised that the project is receiving Community Development Block Grant (CDBG) funds pursuant to the Housing and Community Development Act of 1974, as amended. Consistent with other Federal programs, CDBG requires various Federal laws, regulations and guidelines the successful bidder and their Subcontractors must comply with including but not limited to: Title VII of the Civil Right Act of 1964 and Executive Order 11246; 29 CFR Parts 1, 3, 5, 6, and 7 Davis-Bacon Act; 40 U.S.C. 327-333 Contract Work Hours and Safety Standards Act; 24 CFR Part 75 Section 3.The entire project is subject to Federal prevailing wages. With the understanding that the Davis Bacon Wage Determination modification posted herein was in effect as of the posting date, and that this determination must be checked for an update before submitting a bid; the latest modification within 10 days of bid opening must be used. Attention is called to the fact that not less than the minimum salaries and wages as set forth in the Contract Documents must be paid on this project, and that the Contractor must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex or national origin. Only the Successful Bidder for a contract will be responsible for payment of a fee to PennBid and for bearing the cost thereof. The amount of the fee due to PennBid is either 1/3% (0.0033) of the initial contract award amount for fixed fee contracts or 1/6% (0.00166) of the expected contract value for term contracts and will be invoiced by PennBid to the successful bidder upon award of a contract by the Local Contracting Unit. The minimum fee is set at $100.00 and the maximum fee is capped at $5,000.00. The Township of Middletown reserves the right to reject any or all Bids or to waive any informalities or irregularities in the bidding when, in the opinion of the Township, such rejections or waivers shall be to its interest or advantage. Prior to awarding the contract, bids may be held by the Township for a period not to exceed sixty (60) days from the date of bid openings for the purpose of reviewing the Bids and investigating the qualifications of bidders. All of the base bid work contracted for herein shall be substantially completed within 90 calendar days of the start date given in the written Notice to Proceed. |
