Description

Bid RFIs are due by September 20, 2022 at 10:00am. Prequalification is required for this project. All potential bidders must be prequalified at least five (5) days prior to bid open. The district is utilizing Quality Bidders for prequalification and potential bidders can apply at: portal Bids must be accompanied by a bidder's bond, cashier's check, or certified check for at least ten percent (10%) of the amount of the base bid and made payable to the Encinitas Union School District. If a bid bond is used, it must be issued by an Admitted Surety (an insurance organization authorized by the Insurance commissioner to transact surety insurance in the State of California during this calendar year), which shall be given as a guarantee that the bidder will enter into a contract if awarded the work and will be declared forfeited, paid to, or retained by the District as liquidated damages if the bidder refuses or neglects to enter into the contract provided by the District after being requested to do so. All forms must be completed, signed, and returned with the proposal with original wet signatures. No electronic signatures will be accepted. The successful bidder will be required to furnish the District with a Performance Bond equal to 100% of the successful bid, and a Payment Bond equal to 100% of the successful bid, prior to execution of the Contract. All bonds are to be secured from a surety company that meets all of the State of California bonding requirements, as defined in Code of Civil Procedure section B995.120, and is authorized by the State of California, and all documents required by Code of Civil Procedure section 995.660, to the extent required by law. The successful bidder will be allowed to substitute securities or establish an escrow in lieu of retainment, pursuant to Public Contract Code Section 22300, and as described in the General Conditions. The Contractor shall be required to satisfy the conditions set forth in the contract and Education Code section 45125.2 regarding fingerprinting requirements and student safety prior to permitting any contact with students. Upon award of the contract and before beginning work, the Contractor shall be required to provide a verification of compliance with the student safety provisions of the contract and Education Code section 45125.2. Upon award of the bid, signatures will be required on the enclosed declaration to ensure compliance with the General Conditions and the Education Code. B-2282 CONTRACT DOCUMENTS- 3 - The District will not consider or accept any bids from contractors who are not licensed to do business in the State of California, in accordance with the California Public Contract Code, providing for the licensing of contractors. In accordance with Section 3300 of said Code, the Bidder must be a licensed contractor pursuant to the Business & Professions Code and must be licensed in the following classification: Class-B General Building Contractor License and all sub-contractors must have valid subcontractor licenses for the work to be performed and must maintain the license throughout the duration of the contract.The successful bidder and all subcontractors will be required to comply with the prevailing wage provisions of the California Labor Code and the prevailing wage rate determinations of the Department of Industrial Relations. These rates are on file at the Department of Industrial Relations, Division of Labor Statistics and Research, Prevailing Wage Unit, PO Box 420603, San Francisco, CA 94142-0603, (415) 703-4281. A copy of these rates shall be posted at the job site. It shall be mandatory upon the successful bidder and all subcontractors to comply with all Labor Code provisions, which include, but are not limited to, prevailing wages, employment of apprentices, hours of labor and Department of Contractors and Subcontractors.If the bids subject to this Notice are due on or after March 1, 2015, then pursuant to Labor Code sections 1725.5 and 1771.1, all contractors and subcontractors that wish to bid on, be listed in a bid proposal, or enter into a contract to perform public work must be registered with the Department of Industrial Relations. No bid will be accepted nor any contract entered into without proof of the contractor's and subcontractors' current registration with the Department of Industrial Relations to perform public work. If awarded a Contract, the Bidder and its subcontractors, of any tier, shall maintain active registration with the Department of Industrial Relations for the duration of the Project.This Project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. In bidding on this project, it shall be the Bidder's sole responsibility to evaluate and include the cost of complying with all labor compliance requirements under this contract and applicable law in its bid. The District reserves the right to waive any irregularity and to reject any or all bids. Unless otherwise required by law, no bidder may withdraw its bid for a period of sixty (60) days after date set for the opening thereof.
