Description | The Owner or Designer shall give all orders and directions contemplated under this Contract. In general, the Designer shall provide directions relative to the scope of the work and shall give the initial interpretation of the Construction Documents; provided, however, notwithstanding anything to the contrary, the Contractor shall be responsible for the manner, means, methods, and all other matters relating to performance of the Work. During progress of the Work, the Owner will be represented at the project site by the Owners Representative and/or Designer. The Owner and Designer shall at all times have access to the work whenever it is in preparation or progress. The Contractors shall provide proper facilities for such access and for inspection and observation of the Work. All materials and workmanship used in the work shall be subject to the inspection of the Designer and Construction Representative, and any work which is deemed defective shall be removed, rebuilt or made good immediately upon notice. The cost of such correction shall be borne by the Contractor. Contractor shall not be entitled to an extension of the contract completion date in order to remedy defective work. All rejected materialsshall be immediately removed from the site of the work. If Contractor fails to proceed at once with the correction of rejected defective materials or workmanship, the Owner may, by separate contract or otherwise, have the defects remedied or rejected. Materials removed from the site charge the cost of the same against any monies which may be due the Contractor, without prejudice to any other rights or remedies of the Owner. Failure or neglect on the part of Owner or Designer to observe faulty work, or work done which is not in accordance with the Construction Documents shall not relieve the Contractor from responsibility for correcting such work without additional compensation |
